City ci' Rochester, Minnesota., held in the Council Chaanbers, in te City Tull in : said City, on November 15th,1937. -' President Liddle called the meeting to order at 7: 30 o' cloc?> P.If. , the following members being present: Liddle, Amundsen, Fryer, Green, Lemon, ?doody, Richman. Absent: None. , Upon motion by Richman second by;Amundsen the minutes of the meeting �! of November let,- were approved: President Liddle stated this as being the time set for hearings for x, levying of special assessments for the paving of the alley in Block 17, Original Plat, and for making sewer and water connections on Broadway, and asked if any one present wished to be heard concerning the levying of special assessments on either r: II of said improvements. No one present wished to be heard concerning the levying of { special assessments. ` President Liddle stated this as being the time set for hearing on the I' construction of a sanitary sewer in Fourteenth Avenue Northeast from Fifth Street Northeast to Fourth Street Northeast, and asked if any one present wished to be ,a= heard concerning the said improvement. The following Yk proposals were received and opened at this time: v Martin Paulson, 3457.00; Wm. C.Fraser & Son,$4861,00. President Liddle referred the above bids to the Sewer Committee and the City EnL?ineer for recommendation. Mr. Erwin Briese, Secretary of the Rochester Chamber of Commerce was be -;ore the Council regarding Christmas street lighting. Upon motion by Lemmon second by Richman, the matter of Christmas streE lighting was referred to the Street and Alley Committee with power to act. was before the C©moron Council Mr. James T. Spillane Wrepresenting the property owners on First Street Northwest from Broadway Street North to First Avenue Northwest, protested the ` assessments levied against said g property for the widening of First Street Northwest 51 NOV 1 y 1931 gas Upon motion by Vemmon second by Fryer the above matter. was referred to the Street and Alley Committee and the City Attorney. The reports of the Clerk of the Municipal Court for the week ending November 1st, showing criminal fines collected $233d 20, civil fees received $29 459 'Conciliation court fees received $5 00 and check from Olmsted County $v47,050) for the week ending November 8th, showing criminal fines and costs collected $114.80, civil fees received $6.45, and conciliation court fees received $9 25,, and for . the week ending November 15th, showing criminal fines and costs collected $146.80, civil fees received y$9020, and conciliation court fees received $2050, a were each separately read, and having been previously approved by the City Attorney President Liddle ordered that the same be pierced on file. The report of the City Weirhmaster for the month of October, showing 250 private loads weighed, and total receipts of.y$25:90, was read, and President Liddle referred the same to the Finance Committee. The report of the Building, Electrical and Plumbing Inspector for the month of October, showing building permits issued $56.00, plumbing permits $54 00, and electrical permits issued $150259 was read, And President Liddle referred -the same to the Finance Committee. The surety Bond of Jerome Reichert, in the sum of $3 , 000.00 , covering on sale liquor license at 124 South Broadway, with the Seaboard Surety Company of New York as surety, was read, and on motion by Moody second by Breen, the bond was approved, the surety thereon accepted, and it was ordered that the same be placed on file: The surety bond of Martin Paulson irk the sum of $640.00 with the Fidelity & Casualty Company of New York as surety, .covering the construction of a sanitary sewer on Eleventh Street Southwest from Sixth Avenue Southwest to a point 400'feet southwest, was read, and on motion by Amundsen second by Moody, the bond was approved, +the surety thereon accepted, aril it was ordered that the same be placed on file. An application signed by John J: Dallman for permit to hold three Public dances in the M.W.A.Hall, on November 6th, 13th, and 17th, was read; An application signed,by Henry Foley .for a permit to hold three public -� dances in the.. A.O U:W� hall : on .,;October 239 30th, and November 7th, was reed. An application signed by Carl Peterson for a soft drink dealers license at the second story of the Co -Operative store building was read, and on motion by Mhuhdamseeond by Richman, license was granted. An application signed by Harry a Vinton for a drivers license was read, and on motion by -Richman second -by Amundsen license was granted. .An application. signed by J:,C:Adams for the Town Taxi Company requesting a transfer of taxicab license No.17 from a Buick Sedan bearing state license No. B 216 404, to a Buick Sedan bearing state license No. B.4453, was read, and on motion by Lemmon second by Richman, transfer was granted: A communication signed by WA:Moore, Mayor, announcing the appointment of 00, J. Anderson as Special Policeman for duty at the Modern Woodman Hall, to serve without pay and to hold office until the second Monday in April,1938, was read, and President Liddle ordered that the said communication be placed on file. The following communication from W.AeMoore, Mayor, was read, and President Liddle ordered that the same be placed on file: "November 89 1937. R,? To The Common Council, City of Rochester, Minnesota: v Gentlemen: I am returning the Ordinance entitled, "An Ordinance prohibiting the use of loud dpeakers and amplifiers of 6ny kind, prohibiting the use and operation of motor propelled vehicles with the muffler cutout open and prohibiting all unnecessary sounding of horns on motor vehicles while using the streets or alleys of the city of Rochester, Minnesota," unsigned, because it does not meet the needs for which I think it was intended, as it only prohibits the .use of amplifiers mounted on any vehicle.,,,I mould suggest that you have this revised and include any noise created by an amplifier which can be heard on r the public streets or Rochester. Respectfully yours; WA.Moore," Mayor The City Engineer submitted an estimate of cost in favor of Martin Paulson in the sum of $608.00 for the construction of a sanitary sewer on Eleventh Street Southwest, from Sixth Avenue Southwest to a point 400, feet southwest, and an estimate in favor.of C. CO- Pagenhart in the sum of 41677.25, . for the paving of the east .and west alley in Block 17, Original Plat, and President Liddle ordered th�t the same be placed on file. 482 PJGV �, y 1931 The City Engineer submitted the following specifications for. steam boiler for the sewer -department which were read: " Nov. 15,1937 Hon. Mayor & Common Council ' Gentlemen: Herewith is Estimate of cost and Specification for a steam boiler for Sewer Dept. 1-10 to 20 H.P.Boiler, Internal Combustion Oil Burning, 100 Pounds Working Pressure, including all necessary boiler trimmings, passed by A.S, M; E and National Codes- and insurable in all Boiler Insurance Companies. The above Boiler to be insulated with. two (2") inch Magnesium Block Insulation with Openings for all fittings, hand holes, etc. The estimate of cost $1500.00 with trade in allowance on old Boiler. Respectfully, Arleigh C.Smith ` City Engineer." The Sewer Committee and the City Engineer submitted a communica- tion recommending that the proposal of Martin Paulson in the sum of $457.00 for the construction of a sanitary sewer in Fourteenth Avenue Northeast be accepted and on motion by Amundsen second by Fryer, said report was accepted and ordered placed on file. 3. Co- E: Ginther Chief of the Fire Department submitted s ecifica- tions and estimate of cost for 700 feet of fire hose for use of the Dire =' Department, the estimate of cost being $700.00. Alderman Richman introduced a resolution ordering hearing for i 7:30,o'clock P.M., on November 29th,1937, on the levying of special assessments for sanitary sewer in Eleventh Street Southwest from Sixth Avenue to 400 feet southwest, which was read: Upon motion by Moody second by Richman,that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 3 Alderman Richman introduced a resolution levying special assess- ments for trunk line sewer and water connections•in Broadway Street, which was read. On motion by Amundsen second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. I 483 -- . Block 17, Original, Plat, which was read: Upon motion by Pryer.second by Green, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the sai resolution duly passed and adopted. Alderman Amundsen introduced a resolution authorizing the Public Utilit Board to enter into contract with the L:A.Kepp Electric Company, for installation f. of underground distribution extension on Third Avenue Southwest, at a total lump sum price of ?1800.00, which was ready Upon motion by Green second by Lemmon that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the sai resolution duly passed and adopted: Alderman Affiandsen introduced a resolution adopting the specifications and ordering advertisement for bids for the purchase of 700 feet of fire hose for use of the Fire Depar tme nt of said Cityy which was read. Upon motion by Moody second by Richman,that the said resolution be r adopted as read, and all voting in favor thereof, President Liddle declared the 11 said resolution duly passed and adopted. Alderman Amundsen introduced a resolution ordering advertisement for bids IIfor furnishing sewer steamer for use of the City Engineers Department, bids to be received and opened at 7:30 o'clock P.M., on November 29th,1937,which was read. Upon motion by Fryer second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution granting public dance permit to John J. Dallman for the Woodman Hall, November 6th, lath, and 17th,1937, and fixing the fee at U.00, which was read: Upon motion by Green second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. - Alderman Fryer introduced a resolution granting public dance Ilpermit to Henry Foley for the, A.O.U.W.Hal.l October 23rd, October 30th, and November 7th,19379 which was read Upon motion Moody second by Amundsen, that the said resolution , be adopted as read, and all voting in favor thereof,:President Liddle Ildeclared the said resolution duly passed and adopted. Upon motion by Richman second by Amundsen,that the said resolu- ion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $608.00 from e P erman Ent Improvement Revolving Fund and ordering payment made to Martin aulson for construction of sanitary sewer in Eleventh Street Southwest, fron ixth Ave. S.W. to 400 feet Southwest, which was read. i 10V1 51931 Upon motion by Amundsen second by Fryer that the said resolution be t -voting in favor thereof, President Liddle declared the said adopted as read, and all resolution duly passed and adopted. Alderman L emmon introduced a resolution appropriating 1630.00 from the Permanent Improvement Revolving Fund and $47.25 from the Street and Alley Fund and ordering payment made to C.C.Pagenhart for final estimate on paving the east and west alley in Block 17, Original Plat, under contract and Job No.1888, which was read: Upon motion by Green second by Moody that the.said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said ,resolution duly passed and. adopted. Alderman L emmon introduced a resolution appropriating $ 695.46 from the Street and Alley Fund and ordering payment ,made to .the Street4 a,nd ,fill ey Fund for stock used during,October,1937,which was read. Upon motion by Lemmon second by Richman that the said resolution be > adopted as read, and all voting in favor thereof,, President Liddle declared the said resolution duly passed and adopted. , Alderman Moody introduced a resolution appropriating $666.729 from the Street and Alley Fund, and $3946-95 from the General Fund and ordering payments made to the said funds respectively, for use of equipment during October,19379which was read. _ Upon motion by Richman second by Fryer that the said.resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolutioni ,duly ,passed and adopted.. , Alderman Richman introduced a resolution appropriating $3000-00 from a . , the General Fund and ordering ;payment made to the Motor Sales •& Service Company for balance due on 1937 Ford Sedan $755.00 less trace in allowance of $455.00 for 1935 Ford Sedan .for use of the Police Department of said,City,which was read., upon motion by Amundsen second by'Lemmon,thet the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the sai resolution duly passed -and adopted. 11 Upon motion by Amundsen second bey Fryer the sum of "100.00 was appropriated from the General Fund and ordered paid to WQA.Moore, Mayor,_ for use in his Mayor's Contingent Fund, ,he to properly, account .for the expenditures therefrom.
