HomeMy WebLinkAbout11-23-1937• Nov Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall in said City on November 23,1937 President Liddle called the meeting to order at 5:00 o'clock �) P.M. , the following members being present: Liddle, Fryer, Green, Lemmon, Moody, Richman. Absent: Amundsen. Upon motion by Moody second by Richman, the minutes of the meeting of November 15th,Aere approved. President Liddle stated this as being the time set for receiving and opening bids for the furnishing of all labor and materials for • ( decorative Christmas street lighting. The following bids were received j and opened at this time: H. & He Electric Company $1173.00; Peterson Electric Company 0680.00 , with the notation that said bid does not include the furnishing of any bond or liability insurance. Alderman Richman introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: 0. That the Vid 'and proposal of Peterson Electric Company for the fgrnishing of all labor, materials, etc., necessary for the Christmas street lighting during the 1937 season, in accordance with the specifica- tions for same which -are now on file in the office of the City Clerk, of said City, viz: Lump sum bid for the complete furnishing of material and labor as specified for the sum of $680,00, not including bond or liability insurance: be and the said bid and proposal is hereby accepted. The amount of the. surety bond to be given by the said contractor is hereby fisted at the sum of $680 XO0 " Upon motion by Green second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Upon motion by Fryer second by Moody, the bid of the I+.. & IT Electric Company was rejected and the City Clerk authorized to return the certified check which accompanied said proposal: Upon motion by Richman second by Green the Common Council adjourned to November 29th, at 7:30 o'clock P.M. -City Clerk. ,- Nov ? f; 10�y Minutes of a special meeting of the Common Council of the City of Rohester, Minnesota, held in the Council Chambers in the City Hall in said City on November 26th,1927. President Liddle called the meeting to order at 5:15 o'clock P.M-, the following members being present: Liddle, .Amundsen, Fryer, Green, Lemmon, Moody, Richman. Absent: None: The call for the special meeting was read; -said meeting having been called for the purposd of reconsidering and adjusting the bids for decorative Christmas street lighting; and any.other business the said Common Council might deem proper. President Liddle ordered that said call be placed on file. Alderman Fryer introduced the following resolution,which was read: "WHEREAS, The Common Council of the City of Rochester Minnesota, having deemed it necessary and advisable that decorative lighting be furnished for I Christmas and holiday season, and WHEREAS, The said Common Council duly advertised for bids for the doing of the work in accordance with the plans and specifications on file in the office of the City Clerk of said City, and WIIEREAS, On the- date set for the receiving of bids, two bids were received, one by Peterson Electric Company in the sum of $680:00, but with qualifi- cations attached thereto so that said bid was not made in accordance with the plans and specifications on file, and should have been rejected as not within the speci- fications, and WHEREAS, The H: & H. Electric Company having submitted a bid whhich wa MR not accepted, and WHEREAS, The bid of the said Peterson Electric Company being an illega bid, it- left simply before the Common Council for their consideration the bid of tY: aoiA TT_ A� T-T_ F'1P.eteriC ,romDanv. and ,II-EI2EAS, The laws of the State of Minnesota require'that this munici- pality has no right or authority to accept a bid for this project which is compe- titive in its natur$, where only one legal bid has been received, and WHEREAS, The Common Council inadvertantly accepted the bid of the Peterson Electric Company, and WHEREAS, No contract has been entered into for the carrying out of said project; NOW TH7'ZEFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the resolution dated November 23rd919379 accenting the bid of th Peterson Electric Company be and the same is hereby cancelled and annulled and the bid of the said Peterson Electric Company be and the same is hereby rejected. Be it :nurther resolved: That the City Engineer's Department of said City be and it is hereby authorized and directed to procure the necessary commodities, implements, machinery,, labor, and service and carry out the proposed improvement in such a manner as not to exceed the total expenditure of '680.00. " Upon motion by Green second by Richman that .the said resolution be adopted as read, and all voting; in favor ,thereo:^, President Liddle I declared the said resolution duly passed and adopted: II Upon motion by Moody second by Creen the Common Council adjourned.
