President Liddle called the meeting to order at 7:30 o'clock P.M.,
the following members being present: Liddle, Amundsen, Fryer, Green, Lemmon,
i Moody, Richman. Absent: None.

President Liddle stated this as being the time and place set for a
I
hearing on the construction of curb and gutter and paving of Broadway Street i

. I
uth from the south line of Fourth Street Southwest to the south line of Sixth
Street Southwest and asked if any one present, wished to be beard concerning j
i
either of the said improvements. No one present, wished to be heard. j
At the request of the Common Council, Mr. J. F. McAdams was .present
j
and gave such information as he had concerning the assessment for cutting weeds on!
Elm Park Addition during Lot 13, Block � , _ g the season of 1937.
Alderman ;Moody.: introduced a resolution ordering pl_ns, profiles,
specifications and estimate of cost for the construction of curb and gutter on
Broadway Street south from the south line of Fourth Street Southwest to the south

li line of Sixth Street Southwest, which was read. i
!j Upon motion by Fryer second by Moody that the said resolution be
ad -opted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.

Alderman Moody introduced a resolution ordering plans, profiles,
i
specifications and estimate of cost for the paving of Broadway Street South, from
the south line of Fourth Street Southwest and Southeast tc the south line of Sixth

i Street Southwest and Southeast, which was read.
i Upon motion by Richman second by Green,that the said resolution be

adopted as read, and all voting in favor thereof, President Liddle declared the i
said resolution duly passed and adopted.
The City Engineer submitted plans, specifications and estimate of
cost .for the construction of curb ,and gutter on Broadway Street South, from Fourth
Street Southwest to Sixth Street Southwest, said estimate of cost being .$1,063.75. !

Alderman Richman introduced a resolution adopting the plans, profiles,
t specifications and estimate of cost for the- construction of curb and gutter on
Broadway Street South, as above described, ordering that the same be placed on file
in the office of the City Clerk of, said City, and ordering a hearing on the said

Alderman Amundsen introduced the following resolution,which was
1 . .
"WHEREAS, There has been levied in the Sewer Fund of said City'for
the year 1937, in addition to a portion of the distribution of 10% of the
gross income of the Public Utility Board, the sum of .21400.00 in Code 21
of said Fund for the purchase of a new sewer steaw$er and the sum of $7,400,D
in Code 23 of said Fund for the construction of a trunk line sanitary sewer
in Sixth Street Southwest, from Broadway Street to the southwest sewer lift
station, and
WHEREAS, The Common Council of the City of Rochester deemed it to
the best interests of said City that said sewer steamer be purchased at
once and that said trunk line sanitary sewer be constructed in advance.of i
the collection of said. taxes; and
WHEREAS, Section 176 of the Home Rule Charter of the City of
Rochester, Minnesota, as amended March llth,1924, provides in part as follove
" - - The Common Council may also provide for the is s uanee of bonds or
certificates of indebtedness other than those authorized above, for the
p1prpose of anticipating the collection of general taxes for the year in
which they may be issued, without submitting the proposition to the legal
voters of the City, to the amount of twenty-five thousand dollars ($25000.OJ
to be outstanding and unpaid at any one time,. payablq nqt, more than one year
after the date thereof, out of the General or any other special fund of the
City, with interest thereon at a rate not exceeding six percent (6%) per
annum, - - " and
WHEREAS, It is deemed expedient and necessary that $9,000.00
Certificates of Indebtedness be issued and sold at this time for the
Purpose of providing funds in advance of and in anticipation of the collec-
tion of monies to be derived from taxes levied in 1937.
SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That nine (9) one ,thousand dollar ($1,000.00) City of Rochester,
Minnesota, two percent (2%) certificates of Indebtedness, all dated March
31,1938, five tbousand dollars ($5000.00) thereof maturing July lst,1938,
and four thousand dollars ($4000.00) thereof maturing Dercembe'r lst,1938,
with interest thereon payable on the lst day of July, 19389 and on
December lst,1938, both principal and interest payable at the office of
the =City Treasurer of said City, be issued and sold, such certificates of
indebtedness to be numbered 46 to 54, both numbers inclusive.
Be it further resolved by the said Common Council: That the said
certificates of indebtedness shall be substantially in the following form:

KNOW -ALL' MEN BY THESE PRESENTS: That the, City of Rochester, in the ►
County of Olmsted and State of Minnesota,acknowledges and' certifies that it Is
indebted to, and for value received, hereby promises to pay to the bearer, on/Dec�b'er
1st, 1938, the sum of one thousand dollars ($19000.00) together with interest on
said sum from the date hereof until paid at the rate of two percent (2%) per annum,
payable an and on the 1st day of December,1938, both
principal and interest payable in lawful money of the United States of America,
at the office of the City Treasurer of✓ said City of Rochester,Minnesota, out of the
Sewer Fund of said City, and for the prompt payment of this certificate of indebted-"

Be it further resolved: That the said Certificates of Indebtedness
shall be executed in behalf of said City by the Mayor and attested by the'City
Clerk and the seal of the said City affixed thereto and that the full faith, credit
and resources of said City shall be, and they hereby are irrevocably pledged to the,
prompt and full payment of the principal and interest thereon.

Be it further resolved by the said Common Council: That the City
Clerk of said City be and he is hereby directed to publish a notice of the meeting
of the Common Council of said City which is hereby fixed to be held in the' Council
Chambers, in the City Hall, in said City, on the 28th day of March, A.D.1938, at
7:30 o'clock P.M., for the purpose of opening and eoneidering bids for the said
certificates of indebtedness, in the Rochester Post -Bulletin, a local newspsper
printed and published in -said City, and the official newspaper thereof, in which
said notice shall be published as required by law; the said advertisement for bids for
the sale of the said certificates of indebtedness to be substantially as follows: !
"Notice of sale of $9,000.00.
City of Rochester, Minnesota,
2% Certificates of Indebtedness.
The Common Council of the City of,Rochester, Minnesota, will meet in
Its Council Chambers, in the City Hall, in said City, on the 28th day of March,1938
at 7:30 o'clock P.M.,.to open and consider sealed bids for nine thousand dollars

($9,000.00) City of Rochester, Minnesota, two percent (2%) Certificates of Indebted-;
ness, then to be issued and sold, being an issue authorized by Section 176 of the j
Home Rule Charter of said City, as amended March llth91924, for the purpose of 1
realizing funds for the maintaining of the Sewer Fund of said City and for the j
purpose of providin- funds in advance of and'in anticipation of the collection of '
monies derived from taxes levied in 19379 which said certificates of indebtedness

cates of indebtedness, otherwise to be returned to the unsuccessful bidder
or bidders, such successful bidder will be required to accept delivery and

No bids will be considered for less than par value of the said certificates
of indebtedness and accrued interest thereon.
The Common Council of said City reserves the right to reject any
and all bids. "

Alderman Moody introduced the f ollowing resolut ion,whic h was

"WHEREAS, The .Common Council of the City of Rochester, and the
State of Minnesota, through N.W.Elsberg, its Commissioner of Highways,
have deemed it ex�pedie t and necessary that Broadway Street North and

right-o -way of the Chicago and Northwestern Railway

Company to the south line of Fourth Street Southwest, be resurfaced with
reinforced concrete pavement; and ;

WHE,RFAS, Prior to the resurfacing of the said street it will be
necessary that considerable work be done in the preparation and repairing
of the existing base in said street;
-NOW THEREFORE, Be it and it is hereby resolved by the Common
Council of the City of Rochester, Minnesota:
That the City Engineer of said City be and he is,hdreby instructed
to proceed as soon as possible with the preparation and repair of the said
base and that the vita#e of Minnesota, through N.W.Elsberg, its Commissioner
of.Highways, reimburse the City of Rochester for its proportionate share
of the costs of said preparation andrepair.
Be it further resolved: That the State of Minnesota, through
N.W.Elsberg. its Commissioner of Highways, proceed with the preparation of
plans and specifications, accepting the bids, and letting of a contract
for the resurfacing with reinforced concrete paving of the said above
described street, and that the City of Rochester Reimburse the State of
Minnesota for its proportionate share of said paving.". .
Upon motion by Green second by Moody,that the said
resolution be adopted as read, and all voting in favor thereof, President
