Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, held in the Council Chambers, in the City T?e.11, in said City
on April llth,1938.
President Liddle called the meeting to order at 7: 30 o'clock P.M., the
follo,9ing members being present: Liddle, Pmundsen, Fryer, Green, T,emmon., Moody,
R i chman. Absent -..None.

President Liddle announced this as being the time set for a hearing
on the construction of curb and gutter on Broadway Street South from the south f
line of Fnirth Street to the south line of Sixth Street, and asked if any one pres-
ent wished to be heard concernint said improvement. No one present wished to be �
heard.
President Liddle stated this as being the time set for hearing cn the
paving of Broadway Street South from the south line of Fourth Street to the
South line of Sixth Street and asked if any ene present wished to be heard j
concerning the said improvement. No one present wished to be heard.
This; being the time set for receiving and opening bids for the
construction of curb and gutter and paving of Broadway Street South from the scuth
line of Fourth Street to the south line of Sixth Street, the following, bids were
received and opened at this time:

President Liddle referred the foregoing bids to the Street and
Alley Committed and the City Engineer for recommendation.

President Liddle stated this as being the time set for hearing on
the petition of Floyd and Elvira Plein asking for a change in the classi-
fication of theSouth 91.67 feet of the west 131.15 feet of Lot 1019
Auditor's Plat "A", from a residential to a commercial district, and the
Council heard all persons present who wished to be $esrd in favor of or
against granting of said petition.
A number of petitionsopposing the, proposed change were reed,
and ordered placed on file.
Alderman Richman introduced an -ordinance amending the Zoning
Ordinance of the City of Rochester to change the classification of the
south 91.67 fbet of the west 131.15 feet of Lot 101 Auditor's Plat "A"
from a residential to a commercial district, which was given its first
reading.

On motion by Lemnon second by Amundsen, and all voting in favor
therebf, the rules were suspended and the'said ordinance. was given its
second reading.
Alderman Amundsen introduced the following r esolution,which
was read: .
"WHEREAS, Section 7 of Ordinance. NQ.415 provides that the....
Common Council of.the City of Rochester, on the first Monday in April
in each year, shall establish a minimum wage scale for all Vublic works
for the ensuing official year;
THEREFORE, Be it resolved by the - Common Council of the City of
Rochester , Minnesota:
That for and during the official year following the passage and
adoption of this resolution all contracts hereinafter entered into
for the purpose of performing any work for, the City of Rochester,
involving either new construction work oytrepain on any roads, bridges,
sewers, streets, alleys, parkways, buildings, or any other public
work involving the improvement of public property, shall•bd made upon
the basis that the wages paid to skilled and unskilled labor shall
not be less than the following:

Upon motion by Fryer second by Green that the foregoing salary
recommendations be not accepted, the said motion was carried by all voting in
favor thereof.

The City Engineer submitted specifications and estimate of cost
for one used Bituminous Distributor for use,of the City Engineer's
Department, said estimate of cost being $2600.00 .
The City Engineer submitted estimate of cost
in the sum of $7500 for 150000 gallons road oil and$1820.00 for 2,800
gallons asphalt, said materials to conform With State of Minnesota Highway
specifications..
A communication from Arleigh C.,qnith City Engineer announcing
the appointment of Soren Olsen as First Assistant to the City Engineer,
Gerald Hutchins, Assistant City Engineer, and Anna M. Drews Private
Secretary, John J. Cook Chief Operator at the Sewage Disposal Plant, and
Edward Ranfranz and H.M.Persons as Assistant Operators, was read, and
upon motion by Fryer second by Amundsen, the foregoing appointments were
approved.
A gTmunication from the City Ugrk announcing the appointment of
Lillian R..Sveom as City Clerk's Stenographer, and Ruth Schreiber as
Second City Clerk's Stenographer, was read, and on -motion by Green second
by Amundsen the foregoing appointments were approved.
Alderman Lemmon moved that the action of the Common Council under
date of April 4.th. in fixing the salary of the City Assessor, be
reconsidered. The motion waas.seconded,by`Alderman Amundsen and all
toting in favor thereof, •
Alderman .Amundsen introduced the following resolution,wbich was
read:
"Be it resolved by the Common Council of the City of Rochester,

That that part of a resolution.passed•by.the Common Council
of the City of Rochester on April 4th,1938, fixing the salary of the City
Assessor, his, assitkants and employes be and the. same is hereby rescinded
and annulled. "

BroadW%y Street South, and °
WHEREAS, The City: Engineer. and Chief. of Police, Department have submitte
specifications and estimate of cost .for the furnishing and installation of the said
automatic traffic signals on Broadway Street South, said estimate af:cast being
$5755.40 less $3250.40 :for materials on hand,
SO THEREFORE, Be it resolved by the Common Council of the City of

Alderman Fryer introduced a resolution ordering advertisement for -bids
for the furnishing of approximately 150,000 gallons road oil and 28,000 gallons
of asphalt, said bids to be received and opened at 2:00 o'clock P.M. , on May 2nd,
1938,which was read. °
Upon motion by Green second by Richman,that the said resolution be
adopted as read, and all voting in favor :thereof, President Liddle declared the
said resolution duly.passed and adopted.
Alderman Fryer introduced a resolution accepting the specifications

Alderman Fryer introduced a resolution authorizing the Public
Utility Board to enter into contract with L.M.Feller for installatipn_

of a steam heating extension from the present main in the west alley to

$13,292.00 ,which was read.
Upon motion by Lemon second by Fryer that the said resolution F-

Alderman'Richman introduced a resolution approving the salaries
and` compensations of the employes of the Public Utility Departments and
Alderman Moody moved that the said resolution be' adopted 'as `read,' which_

Alderman Moody introduced a resolution appropriating $223.45 from
the_ General Fund. and ordering payment made to the Schmidt Printing

. Alderman Moody ;intr.oduced a resolution appropriating $270.99 from the
General' Fund and ordering payment made to Ditto, Inc. for Ditto machine, carbon pap
tribbon and ink, for City "Clerk's Office.which was read.
Upon motion by Moody second by Pryer,that the saed resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman -Green introduced a resolution appropriating $862.80 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payroll
for labor during the half mouth ending March 31,1938,which was read.
Upon motion by Moody second by Amundsen,that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $290.40 from
the General Fund to the General Fund, and $816.33 from the Street and Alley Fund
to the'Street and Alley Fund for use of equipment during Mareh,1938,1tieh was read.
Upon motion by Green second by Amundeen,that the said resolution be
adopted as read, and all voting in.Pavor thereof, President Liddle declared the

Alderman,Green introduced a resolution appropriating $31000.00-1from
the Street and Alley Fund for use of the Street and Alley Committee, which was read.
Upon motion by Fryer second by Moody,that the said resolution be
adopted as read, and all voting in favor thereof, Presideblat Liddle declared the said
resolution duly, passed and adopted. -

Common Council had not granted at their meeting on April 4th. Alderman Moody moved
that the action of said Common Council be reconsidered and the motion Was seconded
by Alderw n Fryer..
The application .of .George Wiltgen and Lloyd Joachim for an on sale
non -intoxicating. malt liquor ,license at 607 North Broadway was read, and on motion
by Green second by Richman the said application was granted, provided however,
that no non -intoxicating malt liquor b_e sold after eleven. o'clock P.M., and said
place of business to close at one o'clock midiigut, and all viting to fervor thereof
except Alderman Lemmon who voted "No."

Upon motion by Green second by Amundsen the City Engihmer was
instructed to secure definite information from tree Minnesotq Highway Department
as to the probable time that, the repaving of Broadway Street might be expected,
. also whether or not the State of Minnesota would reimburse the City of Rochester
.for their proportionate share in cage all . work was done by the City of Rochester.
President Liddle announced that .pursuant to the request of the
Common Council he had placed the Building,Electrical and Plumbing Inspector under
the supervision of the Police Committee of the Common Council,
The report of the Public Utility Board for the year ending March. 31st,
193s, was -presented and President Liddle ordered that the same be placed on file.
The report of the cash receipts and disbursements of the City Farm
Fund for the year ending March 31;1938, was presented and President Liddle ordered;
_that the same be placed on file.
The surety bond in the sum of $3,000.00 of the Rochester Lodge #1091,
B.P.O.E., covering their on sale liquor license was read, and on motion by Moody

second by Richman the bond was approved, the surety thereon accepted, and it was
ordered placed on file, and the City Clerk authorized to return the check which

had been deposited in lieu of the said bond.
Upon motion by Richman second by Amundsen the Common Council adjourned .

Alderman Richman introduced a resolution granting public dance permit
to the Junior Chamber of Commerce to conduct two public dances in the Rochester
Armory on April 29th and 30th, and fixing the fee at $6.00, which was read.

Alderman Amundsen introduced a resolution appropriating $213.42 from tth
Fire Protection Fund and ordering payment. made to the Winona Machine & Foundry
Company, for fire alarm bases, ..which was read.
Upon motion by Richman second by Amundsen,that the said resolution be
adopted as read, and all voting in favor thereof, president Liddle declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $313.32. from
the General Fund and ordering payment made to the State of Minnesota Oil Inspection
