the City of Rochester, Minnesota, held in the Council Chambers, in the
City Hall, in said City, on April 18th,1938.
President Liddle called the meeting to order at 7:30 o'clock P.M-.
• the following members being present: Liddle,, Amundsen,! Fryer, Green,
Lemmon, Moody, Richman. Absent: None.
Upon motion by MflocLv secgnd .by Amundsen, the minutes of the
meetings of April 4th and April llth, were approved.
I� President Liddle stated :this •.as, ,being the time set for a hearing
• on the matter of sprinkling, flushing and oiling of streets and avenues,
and asked if any one present wished to be heard concerning the sprinkling
of any of the streets or avenues.
Mr. L.W.Repsold Sr. was before fhe council and presented a peti-
tion asking that Third Avenue Northwest from the North line of Outlot 3,
Northern Addition to a point J70 feet North of the south line of Outlot
5 of said Northern Addition'be included in the' streets to be sprinkled or
II oiled. President Liddle ordered that said petition be placed on file.
Also a communication from tfie Chicago North Western Railway Company "
requesting that the property of the Chicago Northwestern Railway Company
on Second Avenue Northwest and -Fourth Avenue Northwest be not included
in the sprinkling lists, and President, Liddle ordered.that said communi-
cation be placed on file.
President Liddle stated this as being the time set for hearing
on the application of Joe Settimi appealing from the decision of the
Building Inspector in refusing to issue a permit for an addition to a

building on Lot, 11, Block 5, of A.W.Kutzky's Addition. and asked if any
one present wished to be heard concerning th¢ issuance of said permit.
President Liddle stated this as the time set for hearing on the
application Elmer Halling appealing from the decision of the Building
Inspector in fefusing to issue a permit for an addition to a building on

Lot 5, Block 9, Sunnyside Addition, and asked if any one present wished to be
heard concerning the .said ,,matter: ` No one present wished to be heard.
•President Liddle stated this as being the time set for bearing on the
petition of E.E.Harkness for a change in the classification of the south half of
TJot 11, and'all of Lot 12, • in Block 45, 'Original Plat, and asked if any one present
wished to be heard concerning the . said change , of classification. No one present
wished to be heard.

Mr. C.H.Scheuer, Engineer for the W.P.A. Office was. before the Council
regarding infurmatlon as to whether or not the City of Rochester might be able
to set up W_P.A.Projects. -On motion by Lemmon second by Green the matter was
referred to the Street and Aldey Committee, the Sewer Committee, the City Engineer,
and the Board of Park Commissioners. f

Applications signed by Leroy D.Bass, Allan F.Ferguson, and Emery B.
Franz, for drivers licenses were each read, and on motion by Richman second by Lemmoi,
licenses were granted.
Applications signed by Coca Cola Company for four permits to place and
maintain signs were read, and on motion by Amundsen second by Richman, permits were
granted.
An application signed by A.H.Cunningham for the Rochester Junior
Chamber of Commerce for a permit to hold public dances in the Rochester Armory on
April 29th and 30th, was read.
An application signed by David L. Nichols for a license to connect with
sewers and drains in the City of Rochester, together with a surety bond in the sum
of $1,000.00 with the Fidelity & Casualty Company as surety were each separately
read, and on motion by Lemmon second by Richman, license was granted, the bond
approved, the surety thereon, accepted, and it was ordered that the bond be placed on j

the Standard Accident Company as surety, the surety bond of George Parker
in the sum of 01,000.00 with the United States Fidelity & Guarantee Company

Aetna Casual 4y and Surety Company as surety, the bond of Soren Olson in the
sum of $500.00 with the Fidelity & Casualty Company of New York as surety,

A renewal certificate issued by the St.Paul Mercury Indemnity
` Company, renewing the surety bond of Amiel L.Glabe, and W.E.Mitchell, were
each read, and on motion by Lemmon second by Moody the said certificates
were approved and ordered filed.
The surety bond of Bemel Brothers in the sum of $1,000.00
covering junk dealers license, with the Maryland Casualty Company as
surety was read, and on motion by Moody second by Richman the bond was
approved, the surety thereon accepted, and it was ordered that the same
be placed on file.
Alderman Fryer requested that an ordinance amending the zoning
ordinance of the City of Rochester, changint the classification of the
South 91.87 feet of the West 131.16 feet of Lot 101 Auditor's Plat "AV
from a residential -to a commercial district, introduced and given its
first and second readings April llth, be brought up for consideration:

• On motion by Fryer second by Lemon and all voting in favor thereof,
the'rules were suspended and said ordinance was given its third and final reading.
On motion by Fryer second by Richman to adopt said ordinance as read,
and on roll call all members voting' in favor thereof, President Liddle declared

Alderman Fryer requested that an ordinance entitled,"An ordinance
regulating the number of hours of. employment per week for skilled and unskilled
labor upox the puolic work by. contractors when performing same for the City of
Rochester and also by the City of Rochester in performing such work not under

Alderman Amundsen introduced an ordinance amending the Zoning ordinance
of the City of Rochester changing the classification of the south half of Lot 11,
and all of Lot 12 in Block 45 Original Plat, from a multiple dwelling to a
Commercial district, which was given its first readingl
On motion by Lemmon second by Moody the rules were suspended and the
said ordinance was given its second reading.
Upon motion by Moody second by Amundsen gild all voting in favor thereof

Alderman Moody introduced a resolution designating streets and
avenues and parts of streets' and avenues to be sprinkled, flushed, oiled,
or treated during the 1938 season.which was read.
Upoa motion by Moody second by Green that the said resolution
be adopted as reed, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.

Alderman'Moody introduced the folliwng resolution, which was
read:
"Whereas, Equipment and machinery used in the City Engineer's
Department is being handled on an income for use and cost of operation
plan, and
WHEREAS, depreciation charges are being set up as book
accounts only, and
WHEREAS,, It is the opinion of the Streit and Alley Committee
and the City Engineer, that depreciation .charges should be setup as
cash reserves to be used for replacement and purchase of new equipment';
NOW THEREFORE, Be it and it ia,hereby resolved by the Common

. Alderman Richman introduced a resolution closing out codes 2,3,aad 10,_9
in the Street and 'Alley Fund, and transferring the cash balances And uncollected
tax balances, in each of said codes, and authoriziag.the Mayor and City Clerk to draw
warrants upon the City Treasurer for the transfer of said cash balances, which was read.
Upon notion by Fryer second by Amundsen,that the said resolution be
adopted.as read, and all voting in favor thereof, President Liddle declared the said

Alderman Richman introduced a resolution granting the appeal of
Joe Settimi and ordering the City Building Inspector to issue a permit for an

Hospital was brought up and on motion by Moody second by Fryer the
