President Liddle called the meeting to order at 7:30 o'clock I' 11: P.M.. the following members being present: Liddle, Amundsen,' -Fryer, Green, Lermnon, Moody, Richman. President Liddle stated this as being the time set for 'hearing on the placing of Bituminous treatment on the following streets: Third Avenue Southwest from ! I Second Street Southwest to Third Street Southwest, Fourth Avenue Southwest from Second Street Southwest to First Street Northwest, Fourth Place Southwest from First Street Southwest to Second Street Southwest, Seventh Avenue Southwest from Sixth Street Southwest to Eleventh'Street Southwest, and on Sixth Avenue Southwest f from Second Street Southwest to Center Street west, and asked if any one present wished to be heard concerning either of said proposed improvements. ! r Harry V. Hanson, Louis West, Andrew Halstead, and James M. Pruett were before the Council and spoke in favor of the proposed improvement on Seventh ' Avenue Southwest. ! The report of the Clerk of the Municipal Court for the week ending May 2 nd; showing criminal fines and costs collected $259.409 civil fees received $22.00,.,and conciliation court fees received $6.50, were each separately read, and having been previously approved by the City Attorney, President Liddle ordered that the same be placed on file. ! i The report of the Building,Electrical and Plumbing Inspector for the i month of April and to and including May 9th, showing building permits issued $215.00, electrical permits $23,60, and plumbing permits $70.00, was read, and President Liddle referred the same, to the Finance Committee. i The report of the City Wpighmaster for the month of April, showing ! 154 private loads weighed and receipts $15,40, was read, and President Liddle i i I i referred the same to the Finance Committee. i " I 678 I! The report of the City Engineer for the month of April showing �I disbursements for labor from the General Fund $398.78, from the Street and Alley Fund $2341.22 and from the Sewer Fund $176.12 , was read, and io President Liddle ordered that the same be placed on file. ` A oommunication from W.A.Moore, Mayor, announcing the appoint- ment of Fred Blattner as special policeman for duty at the A.O.U.W.Hall and P.D.Claude as specialipoliceman for duty at the City Dumping grounds, each to serve Without pay and to hold office until the second Monday in Apri1,1939, were read and President Liddle ordered that the.same be placed on Pile. A communication from the League of Minnesota Municipalities, announcing the eleventh annual session of the Northwest Fire School, to be held at the University Armory on May 16th to 18th, was read, and Presi- dent Liddle ordered that the same be placed on file. i The following committee reports were read, and President Liddle I; j ordered that the same be placed on file: " Rochester, Minnesota, May 6, 1938. Gentlemen: The undersigned Committee to_ whom the matter of conferring with the Public Utility Board regarding final inspection of all electric work was referred tog do hereby report that said Committee did meet with the Superintendent of the Electric Light Plant, and have agreed upon the follow- ing recommendation: We do hereby recommend that all matters pertaining to electrical inspection be handled by the Building,Electrical and Plumbing Inspector. The Superintendent, of the Light Department will furnish said Inspector a competent electrician at any and all times when called for by said Inspector to assist in all electrical inspection work. The following communication from the Rochester Police.Civil Service Commission was read, and President Liddle ordered that the same be placed on file: "April 9. 1938 j To The Common Council City of Rochester, Minn. • Gentlemen: • An oral and written examination was held Wednesday and Thursday, April 6th and 7th to establish an elegibility list for patrolmen. Mr. C.C. Ludwig and Roy L.Miller of the League of Minnesota Municipalities prepared the examination and graded -the applicants. Applications for soft drink dealees licenses signed by Gerald Buchanan at 524 Fourth Street Southeast, and Louis Precht at 3 Fourth Street Southeast, were each separately read, and on motion by Richman r second by Amundsen, licenses were granted. 11 An application signed by Fredric W. Alderman Richman introduced a resolution deeming it expedient and necessary that a new automobile be purchased for use of the Police , - , - • Department, adopting specifications submitted by the Chief of Police, ordering that the same be placed, on file in the City Clerk's office, and directing the City Clerk to advertise for sealed bids to be received and opened at a meeting of said Common Council to be held at 2 :00 o'clock P.M., June 6th,1938, which was read. Upon motion by Richman second by Amundsen,that the said resolutio-n be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. i 683 Alderman Richman introduced a resolution ordering plans etc., for the placing of bituminous treatment on Third Avenue Southwest from Second Street South- west to Third Street Southwest, Fourth Avenue Southwest from Second Street Southwest i to First Street Northwest, Fourth Place Southwest from First Street Southwest to Second Street Southwest, Seventh Avenue Southwest from Sixth Street Southwest to Eleventh Street Southwest, and on Sixth Avenue Southwest from Second Street Southwest I to Center Street West, and ordering thhtatkagsaid improvements be made and done and I that the cost and expense thereof be paid by special assessments levied as provided i by law, which was read. Upon motion by Green second by Amundsen,tb.at the said resolu- 0 tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution granting public dance permit to Ed. E. Kruger to hold public dances in the A.O.U.W.Hall on May 14th, 21st, ;and 28th,1938, and fixing the fee at $9.009 which was read. Upon motion by Fryer second by Richman, that.the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The following committee report was read, and on motion by Fryer second by Richman the said report was accepted and it was ordered that the same be placed on file: m " May 99 1938 Hon. Alderman Richman introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: ' That the bid and proposal of Thorman W.Rosholt & Company for the furnishing of a bituminous distributor for use of the City Engineer's Department, viz: ROSqO Model RJD distributor mounted on Ford 147" wheelbase truck, equipped with 32 x 6 10 ply dual or 7.50-20 rears 2938.60 Double heating flues 72.00 Wheel type tachometer.complete 60.00 800 gallon capacity instead of 600 gallon capacity, extra 80.00 $ 3150.00 be and the said bid and proposal is hereby accepted." Upon motion by Moody second by Green,that the said resolution be adopted aq read, and all voting in,favor thereof, President Liddle declared the said resolu- tion duly passed and adopted. i Upon motion by Fryer second by Richman, the City Clerk was authorized to return the checks of the unsuccessful bidders. i Alderman Amundsen introduced the following resolution,wrhich was read: "WHEREAS, A district Court Judgment in the sum of $550.29 has been i entered against the City of Rochester in favor of Henry Grassle and WHEREAS, Said Henry Grassle and James T.Spillane, his attorney, have filed the following stipulation; 'IT IS HEREBY STIPULATED AND AGREED, by and between the parties hereto and through their respective attorneys in the above entitled action that the con- L tract made between said parties as of June 21 1932 by and between said parties shall' be cancelled and be of no further effect from and after the 31st day of December, 1937; that the plaintiff shall waive any and all claims he may have or claim to have: against said City of Rochester for any damages caused by reason of said contract or in the carrying out of the terms thereof on the part of the defendant herein; that he will at his own cost and expense clear out and clean out all oversize and strippings in and around said pit; that he will allow the City of Rochester or its assigns within a period,of two years from the date heteof to remove from said pit under plaintiffs supervision gravel or sand, or both, in an amount not to exceed three thousand yards. In consideration of the above stipulations, covenants and agreements ,the said City, of Rochester hereby agrees to pay to the. -said Henry Grassle . the sum of $650.29 as and for payment in full of all verdicts or claims for damages under and by virtue of -the terms of said contract and that said Henry Grassle by the, receipt thereof does hereby release said City of Rochester from any and all further claims on his part by reason thereof.' i 0 NOW THEREFORE, Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: ii That the foregoing stipulations be and the same are hereby accepted and the City Attorney is hereby authorised to sign the same in behalf of the City of Rochester.. Be it further resolved: That the sum of $550.29 be appropriated from the Street and Alley Fund, Code 1, and ordered paid to Henri Grassle for gayment of said judgment. ' Be it fhrther resolved: That the Mayor and City Clerk are hereby authorized and directed to draw warrants upon the City Treasurer and make payment accordingly." Upon motion by Moody second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $283.22 from the Park Improvement Fund and ordering payment made to the Rochester Egg & Poultry Co. for seeds furnished the Park Department, which was read. Upon motion by Amundsen second by Moody,that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $308.28 from the Street and Alley Fund and ordering payment made to General Fund for gasoline furnished from the City Filling Stationtwhich was tread. Upon motion by Moody second by Lemmon,that the said resolution be adopted as read, and all voting in favor thereof, President Liddle j declared the said resolution duly passed and adopted.. Alderman Fryer introduced a resolution appropriating $434.p from the General Fund and ordering payment made to the Rochester Post -Bulletin for official publications and printing during April,. which was read. " be adopted as read, and all voting in favor thereof, President Liddle ideclared the said resolution duly passed.and adopted. , 687 Alderman Lemmon introduced a resolution appropriating `t639.35 from the General Fund and $738.03 from the Street and Alley Pynd and ordering payment made to the Street and Alley Fund for use of equipment .during Apri1,1938,which was read. Upon motion by I,emmon. second by Moody,that the said resolution be adopted as read, and all voting; in favor thereof, President Liddle declared the said resolution duly passed and adopted. i �1 Alderman Green introduced a resolution appropriating $6,084.96 from the ?.I.R.Fund and ordering payment made to J. A. Ganley Company for final estimate for paving South Broadway, Fourth Street to Sixth Street Southwest, which was read. Upon motion by Fryer second by Richman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The matter of setting up P.W.A.projects for the City of Rochester was brought up, and President Liddle appointed the Mayor and the Street and Alley Committee as a committee to investigate the same and report at some future meeting of the Common Council. Upon motion by Dryer second by Green, the Chief of Police was instructed;; to prepare specifications for police radio equipment. Upon motion by Green second by Richman the Common Council adjourned until 7:30 o'clock P.M., on May 23rd, 1938. • City C1erK.
