President Liddle called the meeting to order at 2:00 o'clock
P.M. , the following members being present: Liddle. Amundsen, Fryers Green,
Lemmon, Moody. Absent: Alderman RichmA.n. Alderman Richman being absent on
account of the illness of himself.

Upon motion by Amundsen second b,v Moody the minutes of the
meeting of June 20th were approved.
President Liddle stated this as being the time Set for receiting
and opening bids for the construction of curb and gutter and widening of the

pavement on Third Avenue Northwest from Center Street West to Second Street
I
Northwest. The following bids were received and opened at this times

whom the matter of electric protection for plants and shrubs for the City of

at this time, and President Liddle ordered that the said report be placed on file.
A copy of a requeattion on. Saint Mary' s Hospital for the isolation of

Inez Hoffman, diagnosed to be suffering from chicken pox, was read, and President
Liddle ordered that the same be placed on file.

A notice of claim, signed by Roy Kingeryr-for Connell Kingrey a minor
child, for damages alleged to have been received in the municipal swimming pool at

Soldier Field, was read, and President Liddle referred the same to the City Attorney.;
A communication from W.A.Moore Mayor announcing the appointment of

Willard Hutchins as Special Policeman for duty in the City of Rochester for one

week from June 23rd to June 29th, and from June 30th to July 8th, was read, and �
President Biddle ordered that the same be placed on file.

Ralph B. Compton, Herbert Thienell and George Laack as speciar pAicemen!:for duty
in all parks of the City of Rochester, to serve without pay and to hold office until
the second Monday in Apri191939, was read, and President Liddle ordered that the
same be placed on file.
A communication from W.A.Moore, Mayor announcing the appointment of

Mrs. Thelma R.Degel, Mrs. W.F.Braasch, and Mrs. Harry Gimbert, as members of the i

y year term ending on the third Saturday in July 1941,
was read, and on motion by Green second ty Amundsen the appointments were approved.

A petition signed by Fred Jorgensdn;ee. dl. , asking that . bituminous treat-
ment be placed on Sixth Avenue Southeast from Third Avenue to Fourth Avenue Southeast
was read' and President Liddle referred the same to the Street and Alley Committee
and the City Engineer.

A number of persons owning property in Outlot 7 Cummings Addi-
tion, were before the Council regarding the closing of a driveway in said
block, and on motion by Moody second by Green the matter was referred to the
City Attorney and the City Engineer with the request that they report at the
neat meeting of the Common Council.
A communication from Arleigh' C.Smith, City Engineer,
and Alley
requesting an appropriation of $59000.00"*rom' the ftreet/ Fund, for use of
the Street and Alley Committee. was read, and President Liddle ordered that
the same be placed on file.
An application signed by Lloyd Bennett for a plumbers license,
together with a surety bond in the sum of $1,000.00 with the New Amsterdam
Casualty Company of New York as surety were each separately read, and on
motion by Green second by Moody the license was granted, the bond accepted,
the surety thereon approved and it was ordered that the bond be placed on file.
An application signed by Philip H.Barck, for a license to

connect with sewers and drains in the City of Rohhester, was read, and on
motion by Lemmon second by Amundsen, the •license was granted and the City Clerk
was authorized to issue said license on the filing of a satisfactory surety
bond.
The following applications for soft drink dealers licenses
were reads F.A. Kumm, 1350 Third Avenue Southeast_L Ernest Predmore at 24 First
Avenue Northwest, and Boelter & Predmore at 412 South Broadway. On motion by
Amundsen second by Fryer the licenses were granted.
Applications signed by Gust Spillios for on sale and off sale ,
non -intoxicating malt liquor licenses at.15 Fourth Street Southwest were
each separately read, and on motion by Fryer 'second by Green% licenses were
granted.
An application signed by Edw. E.Kruger for a permit to conduct
a public dance in the A.O.U.W.Hall on July 2 nd,1938, was read.
The surety bond of Flail J. Nietz, in the gum of $19000.00 with
the National Rurety Corporation as surety, covering en Eleetrielan's license
was read, and on motion by Amundsen second by Green, .the bond was accepted the
surety approved and it was ordered that the bond be placed on file.

The surety bond of Louis M. Feller Company, in the sum of $b900.00 with
the Seaboard Surety Vomprtny of New York as surety covering contract for paving the
alley in Block lq Head & McMahon's Addition, was read, and on motion by Lemmon

second by Moody, the bond was accepted, the surety approved and it was ordered
that the same be placed on file.
The surety bond of the Clements Chevrolet Company in the sum of $988.40
with the Fidelity Casualty Company of New York as surety, covering contract for
furnishing a car for use of the Police Department, was read, and on motion by Moody I
second by Green, the bond was.accepted, the surety thereon approved and it was
ordered that the same be placed on file.
A petition signed by Arnold Frank, et. al.,, requesting that Ninth Street
Northwest from Broadway Street North to Second Avenue Northwest, be sprinkled
i}istead of oiled, was read, and President Liddle referred the same to the Street
and Alley Committee and the City Engineer.

Alderman Fryer introduced a resolution adopting the plans etc., for a
trunk line sanitary sewer in First Street Northwest from Thirteenth Avenue to
Sixteenth Avenue Northwest, ordering a hearing on the, said ,improvement for 7:30
o' clock - P.M. , July 18th,19389 and ordering advertisement for bids to be received
and opened at .7:30 o'clock P.M., July 18th,1938, which was read, ,
Upon motion by Moody second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Fryer ' introduced a resolution ordering a hearing on the levying
of special assessments for the construction of curb and gutter on Broadway Street
South, from Fourth Street to Sixth Street, and for the paving of Broadway Street
South from Fourth Street to Siath Street, and also for the paving of the alley
in Block 16, Head & McMahon's Addition, said hearing to be held at 7:30' o'clock P.M.,1

Upon motion by Green second by Fryer, that the said resolution be adopted
as read, and all voting in favor thereof, President Liddle declared the said resblu-

Alderman Fryer introduced a resolution granting public dance permit to
Ed. E. Kruger for the A.O.U. W.Hdll for July 2nd,1938, and fixing the fee at $3.00,
Which was read.
Upon motion by Moody second by Fryer that the said resolution be adopted
as read, and all voting in favor thereof, President Liddle declared the said resolu-
tion duly passed and adopted.
Alderman Fryer introduced a resolution ordering a hearing on the placing
of bituminous treatment on Sixth Street Southeast, from Third Avenue to Fourth
Avenue Southeast, said hearing to be bald at 7:30 o'clock P.M. on July 18tr,1938, I
which was read.
Upon motion by Amundsen second by Fryer,that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said I
resolution duly passed and adopted. i
Alderman Moody introduced a resolution appropriating $.35 from the GenerA.l
Bund, $12.50 from the Sewer Fund, $ 197.50 from the Street and Alley Fund, and ordering
payment made to the Hayes Lucas Lumber Company for brick, and lumber furnished the

from the F.E%Williams Estate Fund and ordering paw ent,made to Simon Stensrud
for share in operation of Williams Business Building, which was read.

Alderman Amundsen introduced a resolution appropriating 827.38 from the
General Fund, $3.80 from the Street & Alley Fund, $28.90 from the Fire Protection
Fund, and $1551.01 from the Lighting Fund, and ordering payment made to the City of

Rochester, Light and Water Department, which was read. j

Alderman Amundsen introduced a resolution appropriating $1852.41 from the
Park Improvement Fund and ordering payment m@.de to the Mayo Trust Fund for payrolls
for labor during the half month ending June 30th,1938,which was read.
Upon motion by Amundsen second by Moody that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $1934.73 from the;
Permanent Improvement Revolving Fund and ordering payment made to L.M.Feller Co., '

for paving the east and west alley and the north half of the north ans south alley in

Block 16, Head & McMahon's Addition,whieh was read.

Upon motion by Fryer second by Amundsen,that the said resolution be

adopted'as reed, and all voting in favor thereof,President Liddle declared the said

Alderman Amundsen introduced a resolution appropriating $5,000.00 from
the Street and Alley Fund for use of the Street and Alley Committee, which was
read.

Alderman Amundsen introduced a resolution appropriating $13030.00 from
the Lighting Fund and ordering payment made to the City of Rochester, Light Departmen
for electricity furnished for lighting of public str-vets and grounds, which was read.

Alderman Fryer introduced a resolution appropriating $787.07

A copy of a resolution passed by the Board of Education of
Independent School District No.8 deeming it expedient to issue the bonds of
!, said School District to the aggregate amount of $400,000.00 for the purpose
of defraying the expense to be incurred in the construction of an addition

to the Central School Building, and a copy of a resolution passed by the
said Board calling a special election to -be held on July 26th,19389 for the
purpose of voting on the question of issuing bonds of said School District in
the aggregate amount of 0400 9000.00 , were each reed, and President Liddle
ordered that the same be placed on file.
Alderman Amundsen introduced the following resolution,which was

"WHEREAS, The Board of Education of Independent School District
No.8 of Olmsted County, otherwise known qs the Board of Education of the
City of Rochester, has filed with the City Clerk a certified copy of the

!' following resolution, which has been adopted by It. -
'Whereas,, the Board of Education of Independent School District
' N0.8 of Olmsted County, Minnesota, otherwise known as the Board of Education
of the city of Rochester, at a regular meeting of said board duly held -on
July 59 1938, adopted a resolution wherein it stated that it was the opinion
of the Board of Education of said School district that it was expedient
to issue the bonds of said school district to the total amount of four hundred
thousand dollars for the purpose of defraying the expenses to be incurred in
!: the construction of an addition to the Central School building, installing
heating,ventilating and plumbing plants therein and "equipping the same with
apparatus and other school furniture.

Said bonds to bear interest at a rate not exceeding four per cent
11 per annum, payable semi-annually, to be dated September 191938 and to mature
and to be of the respective numbers and amounts as in said resolution stated
and that the proposition of issuing said bonds be submitted to the electors
of said district at a special election and meeting thereof to be held on the
23th day of July919389between the hours of 9 o'clock A.M. and 7 o'clock P.M.;

Upon motion by Green second by Fryer that the said resolution be adopted
as read, and all voting in favor thereof, President Liddle declared the said resolu-

Gentlemen,
There has been referred to me the claim of I.V.Wurst
for a new tire in the amount of $33.26, wherein he claims that
while passing over a manhole in our streets the cover gave way
ruining his tire. ,
The bill, as presented to the City,is for a new tire
and as the old tire was on one of his trucks it, no doubt, was
a second hand tire, as if there were no other reason the under- `
signed would recommend that this bill be not paid on account of
the fact that the bill is for an absolute new tire and the amount
would be far more than the reasonable market value of the tire so
ruined.
Therefore I recommend that this bill be not paid.

instructed to convey the information to the Commissioner of Highways that
it is the wish of the Common Council that diagonal parking with stop and go
signs be permitted on Broadway Street in the City of Rochester, and that if
stop and go signs cannot be permitted with diagonal parking that the stop and
go signs be eliminated.

Dora Hannengerger, et. al. , for a change in the classification of the North
198 feet of the west half of Block 45 Original Plat, and on the petition of
the McCallum Land Compary for a change in the classification of Lot 39Block
2, Ireland's Addition was set for 7:30 o'clock P.M., July 18th,1938.
