!' Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota., held in the Council Chambers in the City Hall, in said � f
City, on August 22nd,1938.
President Lemmon called the meeting to order at 7: 30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Fryer, Green, Doody, Richman,
Williams. Absent: None.
Upon motion ray Greed second by Amundsen,the minutes of the meetings of
August 1st and llth, were approved.
President Lemmon stated this 9s being the tide dot for hearing on oiling
of 'the 'following streets: Ninth Street Northeast from Broadway Street Nort t: to
Second Avenue Northeast, the east and west alley in Block r.3, A.W.Kut$ky's Addition,
Ninth Avenue Southeast from Tenth Street'Southeast to Eleventh Street Southeast, Fi
Svraet Northwest from Second Avenue Northwest to Third Avenue Northwest, and the
south end of Thirteenth Avenue Southeast, and asked if any one present wished to
be heard concerning the oiling of any of the above streets. No one present wished
to be heard.
President Liddle stated this as the time set for the adjourned hearing
on the levying of special assessments for paving the alley in block•16, Head &
McMahon's Addition, and Broadway Street South from Fourth Street Southwest to
Sixth Street Southwest, and asked if arty one present wished tolbe heard concerning
the levying of special assessments on either of the said streets. No one present
wished to be heard.
President Lemmon stated this as being the time set for receiving and
opening bids for repairs to the Williams business property. and the following bids
were received and opened at this time:
C. C. Pagenhart $395,00;
T.M.Carstenson 0838.75.
President Lemmon referred the above bids to the Public Grounds Committee
and the building Inspector for recowmendation.

Mr. Goo. E. Brown, representing the Graybar Electric Company, was before
the Common Council with reference to changing the aerial tower for the Police radio
equipment from the Oity water tank to a tower to be erected upon the City Hall for thi
reason that all equipment would be ' centrally located, and President Lemmon referred
the matter to the Policy Committee, &rid the Chief of Police with power to act.

The copy of a' resolut ion passed and adopted by the Public
Library Board requesting authority to enter into a contract itiith F.J.Paine
11 Company .or furnishing 16 tables for the New Library Building for the sum of
j1 41466.64, ralso a copy of a resolution passed by the Public Library Board
!Irequesting authority to enter into a contract with the Schmidt Printing

Company for the furnishing of 120 chairs for the new library building for
the sum of $1524.00 were each read.
F. J. Paine and E.A.Paine were before the Council protesting
the acceptance of the bid of Schmidt Printing Company in the sum of $1524.00
for furnishi-ne- chairs for the Public Library in view of the fact that said
F.J.Paine Company submitted a bid in the sum of $1353,60 or $170.40 less than
the bid accepted.
Alderman Fryer introduced a resolution .uthorizing the Public

Library Board to Anter into contract with time F.J.Paine Company for the
furnishin6 of 16 tables for the Library Building for the sum of $1460.84, which
was read.
Upon wuticn b Green second by Richman,that the said resolution

be adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Fryer introduced a resolution authorizing the Public
Library Board to enter into a contract with Schmidt Printing Company for the
furnishing of 120 chairs for the library building for the sum of $1524.00,
which was read.

Upon motion by Fryer second by Richman,that said resolution
be not adopted as read, end all voting in favor thereof except Alderman
Richman,who voted "No", President Lemmon declared the said resolution not
adopted.
Mrs. Carl Rommel was before the Council regarding the sanitary
sewer in First Avenue Southwest from Fifth Street to Sixth Street Southwest,

u and President Lemmon referred the matter to the Sewer Committee, the Finance
i Committee and the City .Engineer, taid said Committee to report at the next

meeting of the Council.

A petition signed by the Continental Oil Company asking permission to
construct and maintain two driveways on the First Avenue side dnd two driveways ;

on the First Street side of V,e property commonly known as the old post office ,

was read, and on motion by Moody second by Fryer said petition was referred to
the Street and Alley Committee and the City Engineer.

and on motion by Fryer second by Richman, the matter •was referred to the Street
�! & Alley Committee, the City Engineer and the City Attorney, with power to act.

Mr. Louis Capelle was before the Council.regarding the sewer assessment
it levied against the south half of Lot 7, and all of Lot 8, in Block 84, Moe and Old's `.

Addition, requesting that said assessment be waived in as much as the City was

about to condemn the sewer which is servicing his property at the present time. i

The following communication was read, and on motion by Amundsen second by
Green,the said communication was ordered placed on file,and the request granted:

A petition requesting that south Broadway Street south of
Fourth Street Southwest be placed in a limited time zone, was read, and on
motion by Moody second by Amundsen the Chief of Police was instructed to
establish two hour parking limit on Broadway Street South from Fourth Street
Southwest to Sixth Street Southwest.
The report of the Clerk of the Municipal Court for the week
ending Au`';u.st 1st, showing criminal fines and costs collected 335.30,
civil fees received fli l-3.75, and conciliation court fees received 17.001 for
the week ending August Oth, showing criminal fines and costs collected 9324.00,
Civil fees received $12.70, and conciliation cow.•t .fees received 6.25; for
the week endings August 15th, showing criminal fines and costs collected $316.30
*civil fees received !13.00, and conciliation court Lees $4.25; and for the week
ending August 22nd, showing criminal fines $210.20, civil fees 020.00, and
conciliation court fees $6.50, were each separately read, and having been
previously approved by- the City Attorney, President Lemmon ordered that the

Communications from w.A.Moore, Mayor, announcing the appointment
of O.J.Anderson and W.A..Hutchins, as Special Policemen for duty in the City
of Rochester from the week of August 4th to 10, and for the week of August llth
to 17th, were each read.

A notice of claim in the sum of $29000,00 filed by Thomas
Fraser, Attorney for Dorothy Nichols fAr damages alleged to have been
received by a fall on the sidewalk On the east side of Broadway at Second
Street Southeast, was read, and President Lemmon referred the same to the
City Attorney. L
A summons and complaint in District Court in the case of
Joseph Clark against the C:iicago Great Western Railroad Company a corporation.
Patrick H. Joyce and Luther M. Walter as trustees of said Corporation, and
the City of Rochester a municipal Corporation, for damages in the sum of
$1500.00 alleged 0 have been received on the cross walk at Ninth Place

Herewith report of action in compliance with your letter dated
July 28th referring to 'stagnant water nuisance in the old watercourse northeast
of the Chicago Great- Western Roundhouse and South of 5th St. S. E. , and 1st Place

I had previously brought this nuisance to the attention of
the Division Superintendent of the Chicago Great Western Railway in
i
a letter dated June 29th. In compliance with which Mr.Knutson came
down and went over the place with Mr. Strifert', Sanitary Inspector , ,
j and pointed out that the Railway was only concerned on the west bank j
of the watercourse: and that property owners on the East bank were
equally concerned.

! In company wit h the City Engineer and Alderman Green I again
i went over the location and it was decided that if approximately 100
i feet of the old watercourse on the Railway Company's property were
II cleaned out to the entrance of the culvert near the west end of 5th I
Street running under the railway tracks to the river most if not all i
i of the nuisance would be abated.
On the advice of the city attorney another letter was sent
I' to the Division Superintendent of the Chicago Great Western Railway
suggesting that the watercourse be cleaned out as above. Letters were ,
also sent to eight property owners on the East bank notifying them of
the nuisance and requesting its abatement. j

A request from.the Rochester Symphony Orchestra for permission
to use the community room in the City Hall for rehearsal purposes Sunday
afternoons from 2:00 o'clock P.M., to 5: 00 O'clock P.M., for payment of a
Janitors service fee only, was read and on motion by Moody second by Fryer
the City Clerk was instructed to notify said organization that said room
could only be used upon the payment of the regular rental of $3.00.
Mr. Joseph Macke submitted a . y proposal in the sum of $25.00
for the building known as the Sewage Lift Station in Soldier Field, and on
motion by Fryer second by Williams, said offer was accepted, and said work
to be done under the direction of the City Engineer.

Representatives from Burlingame,Hitchcock & Estsbrook,Inc. , G.M.Orr &
Company, and Ellerbee & Company, consulting engineers, were before the Council
offering their services in connection with the proposed sewage disposal plant
project.
IIpon motion by Fryer second by Amundsen, and all voting in favor thereof,
except Alderman Moody, IMb voted "No", Ellerbee & Company were employed to make
preliminary plans and prepare a P.W.A, application for a sewage disposal plant, the
cost of preparing said plans and filing said application not to exceed,however, the
sum of $500.00,
C. E. Ginther Chief of the Fire Department.was before the Council and
requested that some action be taken requiring that all down town business places hav
outside basement openings, and on motion by Amundsen second by Fryer the matter was
referred to the Chief of Police and the City Attorney.
gpdnrmotion by Fryer second by Amundsen the Custodian of the City Hall
was instructed to prepare plans and specifications for the installation of luud
speakers in the Council_ Chambers.
A proposed ordinance submitted by the Rochester Journeymen Plumbers
was referred to the Board of Public Health and Welfare, the City Attorney, the
Building Electrical & Plumbing Inspector and the City Engineer.
