Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall in said
City on September 6th,1938.
President bommon called the meeting to order at 2:00 0clock P.M., the

following members being present; Leamon, Amundsen, Fryer, Green, Moody, Richman !
Williams. Absent: None.
j� Upon motion by Moody second by Richman,the minutes of -the meeting of i
it August 22nd., were approved.

Mr. Frank E.Roth representing a number of persons residing in Outlot 7
Cummings Addition,was before the Council regarding the opening of an alley in said !
i
block, and on motion by Moody second by Williams the matter was referred to the
i, City Engineer and the City Attorney with instructions to take such steps as are
�C necessary to open said alley.
i
ij Mr. Thomas Fraser was before the Council representing the School Board of
i School District No.59 regarding the purchase of a two acre tract of land from the
i
City Hopi Farm for school purposed.
The following communication from the Board of Public Health and Welfare was I

Gentlemen:
I
The Board of Trustees of School District 59, Olmsted County has
approached the Board of Public Health and Welfare relative to the sale of
land for school q pur'l.�oses. The state requires that this school shall have
two acres of land and the Board of Trustees has offered tb buy two acres
from the present hog farm, paying one hundred dollars for the tract. They
have also agreed to pay for the cost of drawing up the necessary deed.
In view of the necessity of obtaining this land to conform to
the State Board of Education's requirements and because the Board of
Public Health and Welfare believes that'it will not handicap the operation '
of the hog farm, the Board recommends that the Council sell School District
59, Olmsted County, two acres of land immediately adjacent to the present
school ground on the terms outlined above; and with the additional stipu-
lation that if the property is not used for school purposes the City of
Rochester be permitted to buy the property back for the sale price; and that
a fence be erected around the school ground to protect the school children from
any dagger from the city trucks going in and out of the driveway.
It is,of course,assumed that the school district will maintain the i
property in good repair.

Alderman Amundsen introduced the following resolution,whie ri was read:
"WHEREAS, The Board of Education of Independent School District No.6 of
Olmsted County, otnerwise Known as the Board of Education of the City of Rochester, na's
filed with the City Clerk a certified copy of the f•Ulowing resolution whi, Y ras been

'Whereas, the Board of,Education of Independent School District Nc.6 of
Olmsted County, Minnesota, of !rwise known as the Board of education of the city of
�! Rochester, at a Lpecial meeting of said board duly bald on Septeiober 6, 1936, adopted
a resolution wherein it stated that it is the opinion of the .Board of Education of
said school district that it is expedient to issue the bonds of said school district to
the total amount of four hundred thousand dollars for the purpose of defraying the
expenses uo bi-, incui red in the construction of L,r, addition to the Central School build-
ing, installing•ileating, ven4` Utting and plumbing plants therein and ^quipping the
same with apparatus and other school furniture.
Said bonds tc bear ing crest at a rate npt exceeding four percent per annum.

Now, therefore, be it resolved that a copy of said resolution and of this
resolution be transmitted by the clerk of this board to the Common Council of the
City of Rochestar -ind that said Common Council be,and it hereby is requested to call a
special election of said school district to be held on the 27th day of September,1936,

of Rochester that a speciai section and meetings of said School District be
held therein on the 27th day of September, 1936, between the hours of nine

Be it further resolved that the City Clerk of said City of
Rochester be, and he hereby is, directed to rive notice of such special elec-

Upon•motidn by Green second by Richtaan,that the said resolution
be adopted as read, and upon toll call all members voting in favor thereof,
President Lemmon declared -the -said resolution duly passed and -adopted.
The report -of the Clerk of the Municipal Court for the week
ending August 29th,showing crimina.1 fines and costs -collected 1224.45, civil
fees received $13a30, and•coneiliation court fees $2.00, was read, and having
been previously approved by the City Attorney, the said report was ordered
placed on file.
the report of the City Weighmaster for tree month of August
showing 84 private loads weighed and total receipts of 08.40 was read, and
'President Lemmon referred the same to the Finance Committee.
The report of the City Engineer f or the month of August showing
disbursements for labor from the General Fund $1096.24, from the Street and
Alley Fund $1457, 50 , from the Sewer Fund w456.19 , and from the Bs idge Fund
$1.79, was read, and President Lemmon ordered that the same be placed on file.
The report of the Building,Electrical and Plumbing Inspector
for the month of August shoving building permits issVed 1.25.00, plumbing
permits $143.00 and Electrical permits $20.75, was read, and President Lemmon
referred the same to the Finance Committee.
A communication from Dr. D. C.Lochead, Deputy Health Officer,
reporting that the Chicago Great Western Railroad Company had made arrange-

ments to remove the accumulated rubbish blocking the culvert and river near
the Great Western roundhouse andby so doing that the nuisance compla,ind, of at
this point would be abated, was read and President Lennon ordered that the same
be placed on file.

A communication from W.A.Moore, Mayor, announcing the appointment of Rex R.
Robinson as a special policeman for duty at the Mayo Civic Auditorium, to serve
without pay and to hold office until the second Monday in Apri191939, was read, and
President Lemmon ordered that the same be placed on file.
A copy of a requisition.by Dr. D.C.Lochead, Deputy Health Officer on
St.Mary's Hospital for the isolation of Mrs. Woodrow Lrarson,residing at 310 Fourth
Street Southeast, diagnosed to be suffering from whooping cough,was read, and Presi-
dent Lennon ordered that the same be placed on file.
A communication from the Council of Parent Teachers Association,expressing
their approval of the program of activities being developed by the Civic Center,was
read', and President Lemr�mon ordered that the same be placed on file.

A communication from the Rochester Chamber of Commerce calling attention to
a resolution passed by the Civic Affairs Committee of the Rochester Chamber of

L Commerce on April 8th,1938,1n opposition to the old post office site being used for
a filling station,was read, and President L6mmon ordered that the same be placed on
file.
A communication from the First Presbyterian Church of Rochester requesting
permission to erect a permanent sign approxi ately 14 inches by 22 inches in size on
the boulevard at the southwest corner of Second Street and Fifth Avenue Southwest,

together with the property owners consent and permission to erect said sign,were
each separately read, and on motion by Fryer second by Amundsen,the said application
was not granted because a CorAon Council had previously ordered that all signs
be removed from boulevards.

System be installed on the roof of the City Hall and have purchased

The surety bond of H. T. Earle in the sum of $1801.00 with the
Western Casuklty and Surety Company as suf ety covering tie construction of
curb and gutt-^r and widening of Third Avenue Northwest from Center Street
West to , Second Street Northwest,, ,vas read, and on motion by Green second by

Ripon motion by Green second by Williams, the City Clerk was
instructed to advertise for bids for the purchase of the property'known as
the Witherst ine property, bids to be taken for the purchase of land and
buildings, or for 'the removal of tire buildings only.
A number of proposals for the removal of the buildings on the
property known as the Witherstine property had been filed with the City Clerk.

Alderman Amundsen introduced a resolution appropriating, t-317.75

Alley Fund, for stock used during August9193a,which was read.
Upon motion by Williams second by Richman,that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Lemmon
declared the said resolution duly, passed and adopted.
Alderman Amundsen introduced a resolution appropriating $373.50

The matter of the purchase of a street sweeper for use of the
City Engineer's Department was brought up, and on motion by Fryer pecund by
Richman,the matter was referred to the Street and Alley Committee and the
City Engineer, said committee to investigate the matter and make report to tre {

Conmion Council as to whether or not the said Council shall call for bids for
i the furnishing of a sweeper.

+ Arleigh C. Smith,City Engineer reported that a pop corn stand was being
' operated on the street in front of the property described as 14 Fourth Street
Southeast, and President Liddle referred the matter to the Chief of Police and the

The City Attorney submitted a lease between the City of Rochester and
Simon Stensrud, parties of the firstpart, and the Community Oil Company, party of
the second part, said lease covering the south two thirds of Lot 7, less the east
35 feet of the south 22 feet, and also the north 22 feet of Lot g, all in Block 10,
of the Original Plat of the City of Rochester, said lease being for a term of five
years commencing January lst,1939, at a rental of $100.00 per month, and on motion
by: Fryer second by Green,said lease was approved and the Mayor and City Clerk were
authorized and instructed to execute the same in behalf of the City of Rochester.
.Alderman Amundsen introduced an ordinance entitled,"An Ordinance prohibit-,
ing the placing on or throwin.� in or on any public street, alley or sidewalk or in any
motor vehicle in the City of Rochester, Minnesota, except with the consent of the owner
or person in charge of said vehicle, of any card, plackrd, handbill, pamphlet,
booklet, manuscript, or any advertising matter of any kind or descriptio:i, except a
single card not exceeding in size 4 inches by 7 inches." which 'gas given its first
r ead ing.
