M. , by..Presi- dent Liddle; and on roll calls the following members were present: Liddle, Amundsen; Fryers Greens Lermmons Moody; and Richman. Absent: Rone: On motion by Amundsen second by Richman; the minutes of the meeting of r November 2 were approveds President Liddle announced this as being the time and place fixed for hearing on the construction of sanitary sewer in Tenth Street Southeast, from Seventh Avenue Southeast to Eighth Avenue Southeast; and asked if anyone pr eseht wished to be hearda ' There was no one present td be heard regarding this improvement; The report of the 'City Weighmaster for the month of October 19369 showing weighing fees collected $420,30; was reads `and President Liddle referred the. same to the Finance Committeeo, The City Clerk reported the receipt of $102:51 from the Franklin Heating Station as one-half cent per M on .29,5019000 'cuf It* of natural gas used there during �Octoher 1936. The reports of the Clerk of Municipal Court for the week ending November 2; 1936, showing cttihinal fines and costs collected 0256.40$ civil fees received a 112,409 conciliation court fees received $205; for the week ending November 99 show- ing criminal fines and costs collected $63;00% civil fees received $10095; conciliati Icourt fees received $300; and for the week ending November 16, showing ettminal fines rand costs collected 0810-00, civil fees received $7.55; conciliation court fees re- lceived .110.75; were each read, and President Liddle referred the same to the City J!Att orney. Copy of isolation requisition on St. Mary's uospital for the isolation of s. Arnold Fredrickson$ living at 215 Fourth Street Southeast; and diagnosed to be ffering from typhoid fever, was read; and President Liddle ordered that the same be laced on file. An application signed by George Wiltgen for a Soft Drink Dealer's License 607 Broadway Street North; was read, and on motion by Richman second by Amundsen, 108 t ilicense was granted: i'. An application signed by Claude L. Bogart, Manager of the Yellow :Cab Company, asking for transfer of taxi cab license #l,from a seven passenger ;:Cadillac bearing State License B-216902 to. five passenger LaSalle bearing ;.St at a License B-341305; was read, and on motion by Amundsen second -by Richman ,transfer was granted: is An application signed by Clifford Megears of Mazeppa, Minnesota; asking for a license to operate a popcorn and confectionery stand on $rhe north curb line at the intersection of Broadway and Fourth Street in the City of Rochester- was read, and President Liddle referred the same to the License !Committee and the Chief of Police: The surety bond of Harry T. Earle with the New Amsterdam Casualty 'Company of New York, as surety thereon, in the sum of 01500-400, covering the ;construction of curb and gutter in Fourth Avenue Southwest; from Second Street !Southwest to Third Street Southwest and from Sixth Street Southwest to Seventh is ;Street Southwest, was read,and on motion by Lemmon second by Moody, the surety thereon was accepted, the said bond approved, and it was ordered -that the same i be placed on file; A A request from the City Engineer asking thtt $29000400 be approp- Iriat ed from the Sewer Farad and $2;000 00 from the Street and Alley Fund, for use of the Street and Alley Committee, was read, and President Liddle ordered !that the same be placed on file: it is The City Engineer submitted specifications and estimate of cost for the furnishing of an automobile to the City Engineer's Department, which it were read4 �I f The following Committee report was read, and President Liddle ordered that the same be placed on file: "Novo, 16; 1936. - Hon. Motion seconded by j ;Amundsen, and upon roll call all members voting"aye", President Liddle declared the j �r said resolution duly passed and adopt ed, Alderman Fryer introduced the following resolution, which was read: "WHEREAS$ Vernon Engle r e si di.Zg at No . 411 9th Avenue S. E: , City of Rochester, Minnesota has appealed to the Common Council of the City of Rochester from the decision of, the Building Inspector of said city refusing to allow him to ;;continue a small automobile repair business in a recently constructed building in :the rear of the above described premises, and i WHEREAS, the said Vernon Engle was using the above described premises as a small automobile repair business prior to the adoption of Ordinance No. 5009 more 1comnonly known as the Zoning Ordinance of said city, and i. WHEREAS, said new building recently constructed is an improvement in revery way over the former location of said repair shop, and II WHEREAS, the said Vernon Engle has in the past used said premises and will in the future continue to use then for the purpose of earning his livelihood for himself and members of his family, and MEREAS, d large majority of the residents and owners of property in the vicinity of said- above described premises have petitioned the Common Council and Zoning Board to allow the said Vernon Engle to conduct his busi- ness on said premises, and WHIMEAS9 said Common Council believes that a strict application it i of thts ordinance would result in difficulties and hardships to the said Vernon Engle and members of his family- and that the interest of all parties p concerned would bit best served by allowing the continuation of said business Under certain restrictions-, THEREFOR Ems, BE IT AND IT IS HEREBY RESOLVED, by the Common Council i of the City of Rochester, Minnesota, I! On motion by Green second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolu- tion duly passed and adopt ed Alderman Richman introduced a resolution approving specifications as sub - mitt ed by the City Engineer for the purchase of an automobile for the City Engineer's Department, and ordering the City Clerk to advertise for bids to be opened at two I o'clock P. M. on December .T, -1936, which was read: On motion by Green second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopt ed , Alderman Moody introduced a resolution appropriating $21000:00 from the Str-eet and Alley Fund and d$2,00040 from the Sewer Fund, for use of the Street and Alley Committee, which, was read; On motion by Moody second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolu- tion duly passed and adopted; 4 Alderman Moody introduced the following resolution, which Was read: "Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That the temporary transfer of $29000j00 made December 311, 1935 from , Code 20 of the General Fund to Code 10 of the Street and Alley Fund; and the temporary: transfer of $3,263.15 made July 279 1936 from Code 20 of the General Fund to Code 10 of the Street and Alley Fund, said funds being used for snow removal; be and the same are hereby made permanent transfers:" On motion by Loon second by Green, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution il duly passed and adopted. Alderman Pryer introduced a resolution recognizing the National Safety Council, Minnesota Public Safety Committee and the Rochester Public Safety Committee, 112 ,and pl edging all po ssibl a coop erat,lon and effort s for the correction of the seriousness in the numerous number of deaths and injuries caused by ;;motor vehicles. !
