Upon motion by Richman second by Fryer,and upon roll call all !

members voting in favor thereof, that the city of Rochester sell to School D
District No.59 of Olmsted County, two acres of land fr ® the City Hog Farm
in accordance with the recommendation of the Board of Public Health and
Welfare, and the Mayor and City Clerk were authorized to execute a deed
accordingly.
f; Mr. Julius Henke was before the Council an# presented a petition
asking that a foot bridge be constructed Across Cascade Creek at Ninth
Avenue Northwest, and on motion by Moody second by Richmanthe said petition
was referred to. the City Enginr*r and the ttreet & Alley Committee.
Mrs. W.E.Lampman was before the Council requesting that no
farther action be taken by the Common Council on the petition for a
sanitary sewer in Seventh Avenue Northwest from Seventh Street Northwest

to Tenth Street Northwest, until searral undesirable families have been
requested to vacate the property they are now occupying.
Mrs. Fred Vesey, , Mrs. Chas. McNe , and Frank Novotne , signers
on said petition were also present and asked that their names be withdrawn
from said petition.

City of Rochester,was before the Council and presented/certified copies of
resolutions passed and adopted by the said Board of Edueation,whieh were
is read, and ordered placed on file:
"Whereas, it is the opinion of the attorney for the Board of

Education of Independent School District No.8 of Olmsted County-,Minnes,ota,
otherwise known as the Board of Education of the City of Rochester,, that
the $400,000.00 of school bonds which were authorized by the voters of said
! district at a special election held in said district on July 26,1938, to be
!
issued, are invalid on the ground that the maturities thereof do not comply
*ith chapter 131 of the laws of Minnesota of 1927.

Now therefore, be it resolved by the Board of Education of
Independent School District No.8 of Olmsted County, Minnesota, otherwise
known as the Board of Education of the City of Rochester, that said bonds

be not executed or issued, and that all proceedings had with reference
thereto be vacated and set aside. "
