AN ORDINANCE AMENDING AND REENACTING SECTIONS
62.412, 62.422, 62.432, 62.441, AND 62.442 OF THE
ROCHESTER CODE OF ORDINANCES, RELATING TO
PERMITTED USES AND STANDARDS IN THE CENTRAL
DEVELOPMENT CORE ZONING DISTRICTS.
THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN:
Section 1. Section 62.412 of the Rochester Code of Ordinances is hereby
amended and reenacted so that the table entitled "SITE APPEARANCE STANDARDS —
CENTRAL BUSINESS DISTRICT AREA/CENTRAL DEVELOPMENT CORE" does not
include, under "List of Permitted Uses," the following categories or any entry for the
following categories: "Manufactured Home Park"; "Semi Transient Accom."; "Repair &
Maintenance"; "Convenience Retail"; "Wholesaling"; "Air Transportation"; and "Light
Industrial". For the permitted use of "Transportation Services," the entry under the column
entitled "Use Type" should read "III."
Section 2. Section 62.422 of the Rochester Code of Ordinances is hereby
amended and reenacted so that the table entitled "SITE APPEARANCE STANDARDS —
FRINGE AREA/CENTRAL DEVELOPMENT CORE" does not include, under "List of
Permitted Uses," the following categories or any entry for the following categories:
"Manufactured Home Park"; "Repair& Maintenance"; "Funeral Homes"; "Automotive Repair
Services"; "Auto Center'- "Car Washes"; "Sales and Storage Lots"; "Convenience Retail";
"Wholesaling"; "Motor Freight/Warehousing"; "Air Transportation"; "Light Industrial"; "Trade
Shops"; "Advertising Signs"; and "Drive In Facilities." For the permitted use of "Auto
Maintenance Services," the entry under the column entitled "Use Type" should read "III."
For the permitted use of"Transportation Services," the entry under the column entitled "Use
Type" should read "III." For the permitted use of"Local Transit," the entry under the column
entitled "Use Type" should read "III."
Section 3. Section 62.432 of the Rochester Code of Ordinances is hereby
amended and reenacted so that the table entitled "SITE APPEARANCE STANDARDS —
MEDICAL AREA/CENTRAL DEVELOPMENT CORE" does not include, under "List of
Permitted Uses," the following categories or any entry for the following categories:
"Manufactured Home Park"; "Funeral Homes"; and "Air Transportation".
Section 4. Section 62.441 of the Rochester Code of Ordinances is hereby
amended and reenacted so that the table entitled "GENERAL ZONING DISTRICT
STANDARDS — RESIDENTIAL AREA/CENTRAL DEVELOPMENT CORE" does not
include, under "List of Permitted Uses," the following categories or any entry for the

following categories: "Manufactured Home Park"; "Convenience Retail"; and "Funeral
Homes". Under the "List of Permitted Uses" a new category entitled "Neighborhood Retail*"
should be inserted. For the permitted use of "Neighborhood Retail*," the entry under the
column entitled "Use Type" should read "111", the entry under the column entitled "Floor Area
Ratio, Type 111, For Incentive Development" should read ".35", the entry under the column
entitled "Minimum % of Landscape Area" should read "26%", the entry under the column
entitled "Permitted Maximum Height (in feet)" should read "30", and the entry under the
column entitled "Required Off-Street Parking" should read 1 per 150 sq ft F A." Under the
"List of Permitted Uses" a new category entitled "Neighborhood Food Sales and Service*"
should be inserted. For the permitted use of"Neighborhood Food Sales and Service*," the
entry under the column entitled "Use Type" should read "III", the entry under the column
entitled "Floor Area Ratio, Type 111, For Incentive Development" should read ".35", the entry
under the column entitled "Minimum % of Landscape Area" should read "26%", the entry
under the column entitled "Permitted Maximum Height (in feet)" should read "30", and the
entry under the column entitled "Required Off-Street Parking" should read 1 per 3 seats."
At the bottom of the table, under "Footnotes," the following should be inserted: "*Maximum
Floor Area is 2,000 s.f. for any single space or single use."
Section 5. Section 62.442 of the Rochester Code of Ordinances is hereby
amended and reenacted so that the table entitled "SITE APPEARANCE STANDARDS —
RESIDENTIAL AREA/CENTRAL DEVELOPMENT CORE" does not include, under "List of
Permitted Uses," the following categories or any entry for the following categories:
"Manufactured Home Park"; "Convenience Retail"; and "Funeral Homes". Under the "List of
Permitted Uses" two new categories entitled "Neighborhood Retail" and "Neighborhood
Food Sales & Service" should be inserted. For the permitted use of"Neighborhood Retail"
and "Neighborhood Food Sales & Service," the entries under the column entitled "Required
Front Yard" should read "15," the entries under the column entitled "Side Yard Least
Width," should read 10", the entries under the column entitled "Minimum Rear Yard"
should read "8", the entries under the column entitled "Hours of Operation" should read
"6AM-10PM", the entries under the column entitled "Exterior Lighting" should read "B", the
entries under the column entitled "Sign Regulations" should read "A", the entries under the
column entitled "Landscape Material Point Base" should read "15.5", the entries under the
column entitled "Exterior Storage Regulations" should read "T", the entries under the
column entitled "Site Location Requirement" should read "A", and the entries under the
column entitled "Bufferyard Indicator' should read W."
Section 6. This ordinance shall become effective as of the date of its publication.
