WHEREAS, the Common Council of the City of Rochester by enactment of Resolution 143-
80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive municipal
plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, Woodcrest Development initiated an amendment to the Rochester Urban
Service Area Land Use Plan to change the land use designation on approximately 26 acres
located west of East River Road N.E., and south of 37t" Street N.E., from the "Commercial"
designation to the "Medium Density Residential" designation; and,
WHEREAS, the Planning Department recommended the approval of the proposed
amendment to the City's "LAND USE PLAN;" and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after published
notice and hearing, recommended the approval of the proposed amendment to the City's "LAND
USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on November 2, 2015, on the matter of the
proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the application did satisfy all of the criteria
applicable to amendments of Land Use Plans based upon the findings of fact proposed by the
Planning Department staff.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the "LAND USE PLAN" as adopted on March 24, 1980, and as thereafter amended, is hereby
further amended by changing the designation on the following -described property from the
"Commercial" designation to the "Medium Density Residential" designation:
That part of the South Half of the Northeast Quarter, which lies east of the
Zumbro River and southerly of the centerline of 37th Street NE, Section 23,
Township 107 North, Range 14 West, Olmsted County, Minnesota, described as
follows -
Commencing at the southeast corner of the Northeast Quarter of said Section
23; thence North 89 degrees 48 minutes 16 seconds West, assumed bearing,
along the south line of said Northeast Quarter, 690.21 feet to the southwest
corner of ALLEN SUBDIVISION for the point of beginning; thence North 00
degrees 33 minutes 09 seconds West, along the west line of said ALLEN
SUBDIVISION, 400.03 feet to the northwest corner of said ALLEN
SUBDIVISION; thence continue North 00 degrees 33 minutes 09 seconds West,
386.91 feet; thence northwesterly 694.05 feet along a nontangential curve,
concave southwesterly, central angle of 20 degrees 44 minutes 38 seconds,
radius of 1917.00 feet and a chord which bears North 76 degrees 04 minutes 14
seconds West, 690.27 feet; thence southwesterly 47.85 feet along a compound
curve, concave southeasterly, central angle of 42 degrees 10 minutes 58
seconds, radius of 65.00 feet and a chord which bears South 72 degrees 27
minutes 57 seconds West, 46.78 feet; thence northwesterly 143.76 feet along a
reverse curve, concave northeasterly, central angle of 126 degrees 43 minutes
01 second, radius of 65.00 feet and a chord which bears North 65 degrees 16
minutes 01 second West, 116.20 feet; thence South 88 degrees 05 minutes 29
seconds West, not tangent to said curve, 194.08 feet; thence South 49 degrees
49 minutes 20 seconds West, 278.56 feet to the centerline of the Zumbro River.,
thence southerly, along said centerline, 908 feet, more or less, to the south line
of said Northeast Quarter; thence South 89 degrees 48 minutes 16 seconds
East, 1245 feet, more or less, to the point of beginning.
Containing 26 acres, more or less.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in
the office of the Director of the Rochester -Olmsted Department of Planning and Housing; the office
of the Director of Public Works of the City of Rochester; and the office of the Director of Building
and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy
of this resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
