WHEREAS, the Common Council of the City of Rochester by enactment of Resolution 143- 80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive municipal plan for the City of Rochester, Minnesota, and environs; and WHEREAS, Oronoco Investments, LLC, initiated an amendment to the Rochester Urban Service Area Land Use Plan to change the land use designation on approximately 7.98 acres of land and 20.53 acres of land from the "Medium Density Residential" designation to the "Commercial" designation, and to change the land use designation on approximately 16.85 acres of land from the "Low Density Residential" designation to the "Medium Density Residential" designation. All of the land is located at the southwest corner of 55t" Street N.W., and 18t" Avenue N.W.; and, WHEREAS, the Planning Department recommended the approval of the proposed amendment to the City's "LAND USE PLAN;" and, WHEREAS, the Planning and Zoning Commission of the City of Rochester, after published notice and hearing, recommended the approval of the proposed amendment to the City's "LAND USE PLAN;" and WHEREAS, the Common Council, after published notice, held a public hearing in the Council/Board Room of the Government Center on February 1, 2016, on the matter of the proposed amendment to said "LAND USE PLAN;" and WHEREAS, the Council determined that the application did satisfy all of the criteria applicable to amendments of Land Use Plans based upon the findings of fact proposed by the Planning Department staff. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the "LAND USE PLAN" as adopted on March 24, 1980, and as thereafter amended, is hereby further amended by changing the designation on the following -described property from the "Low Density Residential" designation to the "Commercial" designation: That part of the Northwest Quarter of the Northwest Quarter of Section 15, Township 107 North, Range 14 West, Olmsted County, Minnesota, described as follows: Commencing at the northwest corner of the Northwest Quarter of said Section 15; thence South 00 degrees 27 minutes 59 seconds West, assumed bearing, along the west line of said Northwest Quarter, 75.00 feet to the south line of the North 75 feet of said Northwest Quarter for the point of beginning; thence continue South 00 degrees 27 minutes 59 seconds West, along said west line, 263.00 feet the south line of the North 338.00 feet of said Northwest Quarter; thence South 89 degrees 44 minutes 10 seconds East, along said south line, 938.83 feet; thence North 00 degrees 15 minutes 50 seconds East, 28.00 feet; thence South 80 degrees 15 minutes 28 seconds East, 382.57 feet to the intersection of the east line of the Northwest Quarter of said Northwest Quarter with the south line of the North 373.00 feet of said Northwest Quarter; thence North 00 degrees 24 minutes 02 seconds East, along said east line, 298.00 feet to the south line of the North 75 feet of said Northwest Quarter; thence North 89 degrees 44 minutes 10 seconds West, along said south line, 1315.96 feet to the point of beginning. Containing 7.98 acres, more or less. BE IT FURTHER RESOLVED by the Common Council of the City of Rochester that the "LAND USE PLAN" as adopted on March 24, 1980, and as thereafter amended, is hereby further amended by changing the designation on the following -described property from the "Medium Density Residential" designation to the "Commercial" designation: That part of the Northeast Quarter of the Northwest Quarter of Section 15, Township 107 North, Range 14 West, Olmsted County, Minnesota, described as follows: Commencing at the northeast corner of the Northwest Quarter of said Section 15; thence South 00 degrees 20 minutes 06 seconds West, assumed bearing, along the east line of said Northwest Quarter, 75.00 feet to the south line of the North 75 feet of said Northwest Quarter for the point of beginning; thence continue South 00 degrees 20 minutes 06 seconds West, along said east line, 1238.47 feet to the south line of the Northeast Quarter of said Northwest Quarter; thence North 89 degrees 34 minutes 01 second West, along said south line, 457.87 feet; thence North 19 degrees 19 minutes 55 seconds West, 261.85 feet; thence North 00 degrees 20 minutes 06 seconds East, 692.43 feet to the south line of the North 373.00 feet of said Northwest Quarter; thence North 89 degrees 44 minutes 10 seconds West, along said south line, 770.30 feet to the west line of the Northeast Quarter of said Northwest Quarter; thence North 00 degrees 24 minutes 02 seconds East, along said west line, 298.00 feet to the south line of the North 75 feet of said 2 Northwest Quarter; thence South 89 degrees 44 minutes 10 seconds East, along said south line, 1315.96 feet to the point of beginning. Containing 20.53 acres, more or less. BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in the office of the Director of the Rochester -Olmsted Department of Planning and Housing; the office 3 of the Director of Public Works of the City of Rochester; and the office of the Director of Building and Safety of the City of Rochester and shall be available for public inspection. BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy of this resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
