HomeMy WebLinkAboutResolution No. 062-16 - Amendment.IncentiveDevelopR2015-004CUP(OliverApartments)RESOLUTION WHEREAS, on May 8, 2015, the City of Rochester Common Council adopted Resolution #208-15 which approved Incentive Development #R2015-004CUP (The Oliver Apartments) subject to 12 conditions of approval; and, WHEREAS, condition of approval #11 found within Resolution #208-15 stated as follows: 11. The Council's actions in approving this development occur in response to the applicant's or his/her representative's oral and written representations as to the appearance of the building design, exterior fagade, and landscaping. As such, the applicant must not deviate from the appearance of the building design, exterior fagade and landscaping as originally presented to the Council without the Council's prior approval; and, WHEREAS, pursuant to condition #11, the developer has requested Council approval of the following changes to the development: A number of interior changes, modifying the number of units from 15 to 12; from 12-one bedroom units and 3 studio units (15 total) to 9-two bedroom units and 3-one bedroom with den units (12 total); and, WHEREAS, the Planning Department staff analyzed the requested changes as follows: "This change reduces the overall density of the proposal from 54.23 units/acre to 46.16 units/acre. The change increases the required parking from 15 spaces to 17 spaces. The change also impacts the exterior elevations; the window locations on the east and west elevations will be slightly adjusted to accommodate the new unit layouts and new windows will be added on both the west and east sides." and, WHEREAS, the Planning Department recommended the following additional condition of approval should the Council approve the requested changes to the development: 1. The applicant intends to use two parking spaces on the adjacent property, 729 1st St SW. A parking facility has not been established on this property, and #R2015-036SDP is a site development plan (SDP) pending review to establish this parking facility. This SDP shall be completed and approved; and, WHEREAS, the Council considered this request at its February 1, 2016, meeting and set the matter on for a public hearing to occur on February 17, 2016; and, WHEREAS, the Council considered this request at a public hearing held during its February 17, 2016, meeting and allowed interested persons to appear and testify on the request; and, WHEREAS, the testimony presented at the February 17th public hearing can be summarized as follows: A. The applicant's representative appeared and gave testimony in favor of the request. B. There was no opposition to the merits of the requested change. C. The process to amend a condition of approval should be formalized by appropriate changes to the zoning ordinance. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City does hereby approve the above -described changes to the development known as Incentive Development #R2015-004CUP (The Oliver Apartments) subject to the above condition of approval #1 as stated above. Resolution #208-15 is hereby amended to include the changes noted herein and the inclusion of the additional condition of approval. The Mayor and City Clerk are authorized to execute any and all documents necessary to implement this resolution.
