HomeMy WebLinkAboutOrdinance No. 4233 - Annex0.36Acres.36thAveNW.ROW.North of CountryClubRoadNW ORDINANCE NO. _____________ AN ORDINANCE ANNEXING TO THE CITY OF ROCHESTER APPROXIMATELY 0.36 ACRES OF LAND LOCATED IN A PART OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 4, TOWNSHIP 106 NORTH, RANGE 14 WEST, OLMSTED COUNTY, MINNESOTA. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. The Common Council of the City of Rochester, per Minn. Stat. § 414.033, subd. 2(2) initiated the process to annex completely surrounded land to the City of Rochester. The land to be annexed is described as follows: That part of the Northwest Quarter of the Northwest Quarter of Section 4, Township 106 North, Range 14 West, Olmsted County, Minnesota described as follows: Commencing at the northwest corner of said Northwest Quarter of the Northwest Quarter; thence on an assumed bearing of North 89º15’45” East. Along the north line of said Northwest Quarter of the Northwest Quarter, 374.46 feet to the westerly th right of way line of 36 Avenue NW and the point of beginning of the parcel to be described; thence South 01º57’45” East, along said westerly right of way line to the north right of way line of Olmsted County CSAH 34; thence northeasterly along said th north right of way line to the easterly right of way line of said 36 Avenue NW; thence North 01º57’45” West, along said easterly right of way line to the north line of said Northwest Quarter of the Northwest Quarter; thence South 89º15’45” West, along said north line to the point of beginning. Containing 0.36 acres, more or less. Section 2. The total quantity of land included in the petition is approximately 0.36 acres in size. Section 3. On January 4, 2016, the Common Council held a public hearing to consider this annexation petition after providing notice pursuant to Minn. Stat. §414.033, Subdivision 2b. 1 Section 4. Following the public hearing, the Common Council of the City of Rochester determined that the land is completely surrounded by land within the municipal limits. Section 5. As provided in Minn. Stat. §414.036, the City shall pay the Township the equivalent of three years’ taxes in two years. There are no township special assessments assigned to or portion of township debt attributable to the land described in Section 1. Section 6. The City’s estimate of electrical service cost at the time of annexation is (a) .0981 per kilowatt-hour from January through May and October through December, and (b) .1174 per kilowatt-hour from June through September. Section 7. Therefore, pursuant to Minn. Stat. §414.033, subd. 2(2), the land described in Section 1 above is hereby annexed, added to and made a part of the City of Rochester, Minnesota, as if it had originally been a part thereof. Section 8. Present and future owners of the lands annexed by this ordinance are hereby notified that in addition to the usual assessments, it is the intention of the Common Council to assess against benefited property all or a portion of the cost of any storm sewer, water tower, pumping station, and trunk line sanitary sewer construction, heretofore or hereafter undertaken to serve the area annexed. Section 9.
