WHEREAS, chapter 117C of the Rochester Code of Ordinances authorizes the issuance of
a Special Event permit for an event where: (a) amplified sound is used; (b) a public way is closed
for the benefit of event attendees; (c) a temporary alcoholic beverage license is present as part of
a community festival; or (d) a considerable number of members of the public may be adversely
impacted; and
WHEREAS, a policy is needed to resolve a conflict involving two or more applicants
seeking a Special Event permit for similar events to be held at the same time in the same location;
and,
WHEREAS, the Council adopts this resolution in order to provide that policy.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that a person who received a Special Event permit for a particular date in a particular year is not
eligible to receive a Special Event permit for the same date in the succeeding year if, during a 30-
day time period beginning 180 days and ending 150 days prior to the same date in the succeeding
year, another person receives a Special Event permit for that same date.
