WHEREAS, on June 18, 2015, the City of Rochester Common Council adopted Resolution
#305-15 which approved Incentive Development #R2015-015CUP (501 on 1st) subject to 13
conditions of approval; and,
WHEREAS, condition of approval #13 found within Resolution #305-15 stated as follows:
13. The Council's actions in approving this development occur in response to the
applicant's or his/her representative's oral and written representations as to
the appearance of the building design, exterior facade, and landscaping. As
such, the applicant must not deviate from the appearance of the building
design, exterior facade and landscaping as originally presented to the
Council without the Council's prior approval; and,
WHEREAS, pursuant to condition #13, the developer has requested Council approval of
the following changes to the development: The change to the facade as proposed is to the
building walls within the confines of the alley that cuts through the middle of the building and
to the part of the building proposed for gas meter attachment. The change will be from a
"Veneer stone" to a colored rock -faced block. The block is of a different texture and different
shade of gray than the veneer stone as pictured. The proposed balcony design change is
from a glass panel below the aluminum railing to a design using aluminum "pickets" attached
to the aluminum railing; and,
WHEREAS, the Planning Department recommended the following three additional
conditions of approval should the Council approve the requested changes to the development:
14. That the color of the railings and "pickets" be consistent on all balconies
and with the prefabricated aluminum balcony floor supports as noted in
the submittal material by the applicant; and,
15. The railings and "pickets" planned for the fifth floor rooftop balcony match
the design and color for the other balconies along the facade of the
building;
16. The landscape plan as approved and included as Sheet L5.1 in the
original submittal must not be changed in that portion of the site involved
in the placement of gas meters attached to building located in the rear
parking lot in order to provide screening of the meters and the facade;
and,
WHEREAS, the Council considered this request at a public hearing at its February 17,
2016, March 14, 2016, and March 21, 2016, meetings; and,
WHEREAS, at the March 21st council meeting, the Council concluded that the developer's
request can be approved if the request is amended to read as follows:
A. Air Craft product on exterior of the building should be similar to that found at the
Metropolitan Market Place.
B. Picket -style railing colored to match building plus money, if available, for aesthetic
improvement of neighborhood realm.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the City does hereby approve the above -described two changes to the development known as
Incentive Development #R2015-015CUP (The Oliver Apartments) subject to the three conditions
described herein. Resolution #305-15 is hereby amended to include the changes noted herein
and the inclusion of the three additional conditions of approval.
The Mayor and City Clerk are authorized to execute any and all documents necessary to
implement this resolution.
