HomeMy WebLinkAboutResolution No. 146-16 - CassidyRidge.WetlandReplacementRESOLUTION WHEREAS, Kurths Bay Co., LLC, proposed the filing and excavating of 0.34 acres of a Type 2 wetland associated with the Cassidy Ridge development. The wetland consists of a drainageway the collects the flow of springs and seeps from wetlands associated with the Decorah Edge setting upgradient of the development. The wetland is proposed to be filled to allow for the construction of a new residential development, and specifically a several lots and associated connecting street and a proposed regional stormwater pond; and, WHEREAS, the Technical Evaluation Panel ("TEP") reviewed the alternatives and found that they meet the minimum standards for sequencing. The Technical Evaluation Panel agrees that avoidance of the wetlands is not feasible due to the configuration and location of the wetland, existing drainage patterns, size and long term viability given the proposed surrounding development. The minimum replacement acreage is 1.01 acres. The applicant proposes replacement at the Schoenfelder Wetland Bank located in the Root River watershed and Olmsted County near Chatfield; and, WHEREAS, the wetland replacement is at a 2.1 ratio because the replacement wetland is part of a wetland bank in the same service area. The TEP did not object to the wetland replacement plan; and, WHEREAS, the TEP reviewed the application and recommended approval subject to the below described conditions- 1. The developer shall complete the purchase of wetland credits from the Schoenfelder wetland bank; 2. The wetland bank account holder shall complete and submit the Transaction Form for Withdrawal of Wetland Credits to BWSR and a copy to the City of Rochester wetland administrator; 3. No impacts to the wetland may commence until the credits have been debited and a copy of the Transaction Form has been received by the City of Rochester wetland administrator, account holder and the developer; and, WHEREAS, this matter came before the City of Rochester Common Council on April 18, 2016, for a final decision on the replacement plan. The Council considered all information presented to it including that information found within the Council Agenda packet. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Delineation and Replacement Plan presented by Kurths Bay Co., LLC, for the filing of 0.34 acres of Type 2 wetland associated with the Cassidy Ridge development subject to the above three conditions. The Mayor and the City Clerk are authorized and directed to approve this plan on behalf of the City. PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS DAY OF , 2016.
