WHEREAS, on June 18, 2015, the City of Rochester Common Council adopted Resolution
#305-15 which approved Incentive Development Final Plan #R2015-015CUP 501 on 1st subject to
13 conditions of approval; and,
WHEREAS, condition of approval #13 found within Resolution #305-15 stated as follows:
13. The Council's actions in approving this development occur in response to the
applicant's or his/her representative's oral and written representations as to
the appearance of the building design, exterior fagade, and landscaping. As
such, the applicant must not deviate from the appearance of the building
design, exterior fagade and landscaping as originally presented to the
Council without the Council's prior approval; and,
WHEREAS, pursuant to condition #13, the developer/applicant has requested Council
approval of the following modifications of the Streetscape and Landscape Plans along Second
Avenue S.W., to add an outdoor dining patio along the east side of Second Avenue S.W. The
developer/applicant submitted plans and narrative to include modifications of:
• Removal of two on street parking stall
• Realignment of the landscape materials
• Relocation of Bike Racks
• Relocation of Benches
The developer/applicant requested a change in color of the awning from brown, as indicated in the
original plans and in the renderings, to black. The developer/applicant has requested that 501 on
First, LLC have the opportunity to select a more decorative bike rack than originally approved in
the Final Incentive Plan; and,
WHEREAS, the Planning Department recommended the following additional condition of
approval should the Council approve the requested changes to the development:
14. The applicant shall provide one full-size and one 11x17 set of plans,
renderings, elevations and graphics with all modifications, changes and/or
additions reflected. This plan set will be stamped as approved for future
reference by the Planning Department; and,
WHEREAS, the Council considered this request at a public hearing at its July 18, 2016,
meeting; and,
WHEREAS, at the July 18t" council meeting, the Council concluded that the developer's
request should be approved only for that area known as the "Bubble Area" as depicted on the
attachment.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the City does hereby approve the above -described changes to the development known as
Incentive Development Final Plan #R2015-015CUP 501 on 1st subject to the new condition of
approval #14 only for that area known as the "Bubble Area" as depicted on the attachment.
Resolution #305-15 is hereby amended to include the changes noted herein and the inclusion of
the additional condition of approval (condition #14).
The Mayor and City Clerk are authorized to execute any and all documents necessary to
implement this resolution.
