WHEREAS, on December 16, 2013, the City of Rochester Common Council adopted
Resolution #626-13 which approved Mixed Use Development #R2013-028CUP by JLR Dwellings,
LLC, subject to nine conditions of approval; and,
WHEREAS, condition of approval #9 found within Resolution #626-13 stated as follows:
9. The Council's actions in approving this development occur in response to the
applicant's or his/her representative's oral and written representations as to
the appearance of the building design, exterior fagade, and landscaping. As
such, the applicant must not deviate from the appearance of the building
design, exterior fagade and landscaping as originally presented to the
Council without the Council's prior approval; and,
WHEREAS, pursuant to condition #9, the developer has requested Council approval of the
following changes to the development-
1. Addition of a window to the second floor on the northernmost part of the
west building elevation;
2. Modification or deletion of three areas of horizontal black banding;
3. Construction of column cover on the east elevation with brick instead of
prefinished metal;
4. Metal lettering sign for "CRW architecture + design group was not installed;
5. Parking lot was installed with a reinforced concrete surface. Asphalt was the
identified surface on the approved drawings;
6. A timber retaining wall on the approved drawings was not installed because
of a change in slope along the north property line;
7. Plants have been added to the site in addition to those shown on the
landscaping plan; and,
WHEREAS, the Council considered this request at its August 15, 2016, meeting; and,
WHEREAS, the Planning Department made no recommendations for any additional
conditions of approval should the Council approve the requested changes to the development;
and
WHEREAS, at the August 15th council meeting, the Council concluded that the developer's
request should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the City does hereby approve the above -described changes to the development known as
Mixed Use Development #R2013-028CUP by JLR Dwellings, LLC. Resolution #626-13 is hereby
amended to include the changes noted herein.
The Mayor and City Clerk are authorized to execute any and all documents necessary to
implement this resolution.
