HomeMy WebLinkAboutResolution No. 374-16 - Amend.IncentiveDevelopFinalPlanR2015-026CUP.BuckeyeLLCRESOLUTION WHEREAS, on November 2, 2015, the City of Rochester Common Council adopted Resolution #549-15 which approved Incentive Development Preliminary Plan #R2015-026CUP by Buckeye, LLC subject to ten conditions of approval; and, WHEREAS, condition of approval #10 found within Resolution #549-15 stated as follows: 10. The Council's actions in approving this development occur in response to the applicant's or his/her representative's oral and written representations as to the appearance of the building design, exterior fagade, and landscaping. As such, the applicant must not deviate from the appearance of the building design, exterior fagade and landscaping as originally presented to the Council without the Council's prior approval; and, WHEREAS, pursuant to condition #10, the developer has requested Council approval of the following changes to the development- 1. Relocation of one bike rack from the Third Avenue frontage to the Fourth Street frontage; 2. Changes to tree spacing along Third Avenue to make spacing more consistent; 3. Lengthening of tree planter areas along the Third Avenue frontage; 4. Adjustment of the garage entry wall several feet to the south to accommodate mechanical system needs; 5. Replacement of sheet pilings with concrete block for south wall along underground parking level P1; 6. Alteration to canopy at northwest corner to have a curved edge at corner instead of square edge; 7. Change to exterior wall recess for units 216, 217, and 218; 8. Balcony access location change for units 215, 315, 415, and 515; 9. Further development of amenities area of roof deck and adjacent club room; 10. Minor modifications to units 604, 615, and 616; 11. Further development of details, equipment locations, and sizes on roof plan; 12. Update to penthouse overhang thickness; 13. Shift in balcony doors and openings for southwest corner units; 14. Split face concrete block on south and east exterior wall to be painted instead of having an integral color; 15. Changes from metal fascia on penthouse roof and Level 1 soffit to StoQuik Silver DrainScreen system over cement board; 16. Various changes to exterior siding material from cement siding to a StoQuik Silver Drainscreen system. Colors and scoring patterns generally to remain the same with a few exceptions in penthouse roof soffit and exterior wall areas labeled SDG-2; 17. Addition of second brick veneer option on street level; 18. Change in construction method in exterior wall to use prefabricated exterior wall panels; 19. Relocation of generator room from below -grade parking level to Level 1; 20. Minor changes to Entry Lobby at the northwest corner of the building; and 21. Redesign of second story roof deck lobby to become part of corridor and adjacent units; and, WHEREAS, the Planning Department made no recommendations for any additional conditions of approval should the Council approve the requested changes to the development; and, WHEREAS, the Council considered this request at its August 15, 2016, meeting; and, WHEREAS, at the August 15t" council meeting, the Council concluded that the developer's request should be approved. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City does hereby approve the above -described changes to the development known as Incentive Development Preliminary Plan #R2015-026CUP by Buckeye, LLC. Resolution #549-15 is hereby amended to include the changes noted herein. The Mayor and City Clerk are authorized to execute any and all documents necessary to implement this resolution.
