HomeMy WebLinkAboutResolution No. 382-16 - StateAidDesignVarianceRESOLUTION WHEREAS, the City of Rochester has installed traffic calming measures on certain Municipal State Aid streets; and WHEREAS, the City has installed a temporary traffic calming measure along Fairway Drive N.W., in support of the 55t" Street N.W., construction project and a permanent traffic calming measure along Fox Valley Drive S.W.; and, WHEREAS, permanent traffic calming measures were installed on Fox Valley Drive S.W. at the request of abutting property owners and include speed tables, landscaped median islands, and entrance features. Before the traffic calming measures, the 85th percentile speed was in access of 35 mph. After the traffic calming measures were constructed, the 85th percentile was at or slightly above 30 mph; and, WHEREAS, because the design speed for traffic to safely navigate the speed tables is 20 mph, the City seeks a design variance to Chapter 8820.9936, which requires a minimum design speed of 30 mph. NOW THEREFORE BE IT HEREBY RESOLVED by the Common Council of the City of Rochester that the City hereby request a variance from the Minnesota Department of Transportation State Aid Operations Rules Chapter 8820.9936 MINIMUM DESIGN STANDARDS, URBAN; NEW OR RECONSTRUCTION PROJECTS to allow permanent traffic calming measures on Fox Valley Drive S.W. BE IT FURTHER RESOLVED that the Common Council hereby indemnifies, saves and hold harmless the State of Minnesota and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the permanent traffic calming measures on Fox Valley Drive S.W. PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS DAY OF , 2016. ATTEST: PRESIDENT OF SAID COMMON COUNCIL CITY CLERK APPROVED THIS DAY OF , 2016.
