AN ORDINANCE CREATING AND ENACTING
SECTION 66.108 TO THE ROCHESTER CODE OF
ORDINANCES, RELATING TO THE ADOPTION OF
AN INTERIM ORDINANCE REGULATING THE
ISSUANCE OF ANY LAND USE CERTIFICATE,
APPROVAL, OR PERMIT FOR THE INSTALLATION
OF A PARKING FACILITY AND/OR THE EXPANSION
OF PARKING WITHIN ANY R-3 OR R-4 ZONING
DISTRICT.
THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN:
Section 1. Section 66.108 of the Rochester Code of Ordinances is hereby created and
enacted to read as follows:
66.108 INTERIM ORDINANCE:
a. The purpose of this ordinance is to protect the health, safety, and
welfare of the citizens.
b. Recently, there is a pattern within the City of Rochester whereby
residential structures located within residential neighborhoods in the
R-3 or R-4 zoning district are being demolished and the use of
property is converted to a parking lot or parking facility. The
expansion of parking lots and parking facilities in residential
neighborhoods causes deterioration within the neighborhoods,
defeats the desire for walkable neighborhoods, causes a decrease in
adjacent property values, and compromises the character of a
residential area. This activity threatens the integrity and quality of life
of the City’s core neighborhoods and, if allowed to continue without
regulation, threatens the public’s interests in livable neighborhoods.
c. The Common Council is concerned about the increasing practice of
installing parking facilities and/or expanding parking in residential
neighborhoods. The Council believes there is a need to examine this
matter in greater detail to determine whether additional land use
regulations are needed.
d. The Council has authorized a study by the City Administrator's Office,
the City Attorney's Office, and the Planning Department for the
purpose of considering the amendment or adoption of official controls
relating to the installation of a parking facility and/or the expansion of
parking within a R-3 or R-4 zoning district.
e. The Council is concerned that the continued conversion of properties
to parking within any R-3 or R-4 zoning district during the pendency of
the above-mentioned study may compromise the results of that study,
threaten the integrity of the planning process, and harm the public’s
health, welfare and safety.
f. Minnesota Statutes, Section 462.355, Subd. 4, authorizes the City to
adopt interim zoning ordinances applicable to all or a part of the City
for the purpose of protecting the health, safety, and welfare of its
citizens, which ordinance may regulate, restrict or prohibit any use or
development within the City for a maximum period not to exceed one
year.
g. It is hereby found and determined that it is in the best interest of the
sound, aesthetic and efficient development of the City as a whole, as
well as in the public’s health, safety and welfare interests, that the
authority granted by the above-mentioned Minnesota Statute be used
by the City with reference to this portion of the City.
h. The City hereby prohibits the issuance or approval of any land use
certificate, permit, or approval that would otherwise permit the
installation of a parking facility and/or expansion of parking within the
R-3 or R-4 zoning district.
i. The definition of the term “parking facility” is found at R.C.O.
§§60.200, 62.145(7). The term “parking” shall include the terms “off-
street parking”, “parking space” as defined by R.C.O. §60.200.
Section 2. Sections 60.130 through 60.136 of the Rochester Code of Ordinances, entitled
"ENFORCEMENT POLICY", are hereby adopted in their entirety by reference as though repeated
verbatim.
Section 3. This ordinance shall be effective for those applications initially filed with the
Planning and Zoning Department after October 17, 2016, and continues in effect for a period of
time not to exceed one year from the date of adoption.
