WHEREAS, the Common Council of the City of Rochester by enactment of Resolution 143- 80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive municipal plan for the City of Rochester, Minnesota, and environs; and WHEREAS, Willow Creek Commons LLC, initiated an amendment to the Rochester Urban Service Area Land Use Plan to change the designation of land located south and east of Willow Creek, north of 48t" Street S.W., and west of Highway 63 from "Industrial" to "Medium Density Residential;" and, WHEREAS, the Planning and Zoning Commission of the City of Rochester, after published notice and hearing, recommended approval of the proposed amendment to the City's "LAND USE PLAN;" and WHEREAS, the Common Council, after published notice, held a public hearing in the Council/Board Room of the Government Center on June 19, 2006, on the matter of the proposed amendment to said "LAND USE PLAN;" and WHEREAS, the Council determined that the Applicant satisfied all of the criteria applicable to amendments of Land Use Plans. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter amended, is hereby further amended by changing the designation on the following -described property from the "Industrial" designation to the "Medium Density Residential": A part of the Northwest Quarter of Section 26, Township 106 North, Range 14 West, City of Rochester, Olmsted County, Minnesota, described as follows: Commencing at the southwest corner of said northwest quarter; thence easterly along the south line of said northwest quarter, South 89 degrees 50 minutes 46 seconds East, assumed bearing, 848.80 feet to the point of beginning: thence North 14 degrees 20 minutes 45 seconds West, 391.27 feet; thence North 29 degrees 47 minutes 39 seconds West, 901.93 feet; thence North 20 degrees 23 minutes 36 seconds West, 586.71 feet; thence North 55 degrees 42 minutes 37 seconds East, 454.17 feet; thence South 86 degrees 04 minutes 37 seconds East 1011.60 feet; thence North 25 degrees 02 minutes 56 seconds West, 200.00 feet; thence South 89 degrees 47 minutes 30 seconds East, 743.13 feet to a point on the northwesterly line of Parcel 10, Minnesota Department of Transportation Right -of -Way Plat Number 55-44; thence South 43 degrees 12 minutes 40 seconds West along the northwesterly line of said Parcel 10, 684.02 feet; thence South 46 degrees 47 minutes 20 seconds East along the southwesterly line and to the most southerly corner of said Parcel 10, 100.00 feet; thence South 20 degrees 27 minutes 27 seconds West, 700.11 feet to the beginning of a curve concave to the southeast having a radius of 533.00 feet; thence southerly along the arc of said curve through a central angle of 19 degrees 54 minutes 37 seconds, 185.22 feet; thence South 00 degrees 32 minutes 50 seconds West, 674.33 to the south line of said northwest quarter; thence westerly along said south line North 89 degrees 50 minutes 46 seconds West, 790.25 feet to the point of beginning. Containing 60.85 acres, more or less. BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in the office of the Director of the Rochester -Olmsted Department of Planning and Housing; the office of the Director of Public Works of the City of Rochester; and the office of the Director of Building and Safety of the City of Rochester and shall be available for public inspection. BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy of this resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
