AN ORDINANCE CREATING AND ENACTING SUBDIVISIONS 8
AND 9 TO SECTION 106A.01, AND AMENDING AND
REENACTING SECTION 45B.10, SUBDIVISIONS 4 AND 6 OF
SECTION 106A.01, AND SUBDIVISION 3 OF SECTION 106A.18
OF THE ROCHESTER CODE OF ORDINANCES, RELATING TO
THE DEFINITION OF ANIMAL AT LARGE, BY COMMAND, AND
THE PRESENCE OF ANIMALS WITHIN PARKS.
THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN:
Section 1. Subdivision 8 of Section 106A.01 of the Rochester Code of Ordinances is
hereby created and enacted to read as follows:
Subd. 8. "Off-Leash Area" means any of the following areas:
A. Any park, portion of park land, or public place that is not
described in subdivision 9; or
B. Any public place posted with a sign that reads "Off-Leash
Area."
Section 2. Subdivision 9 of Section 106A.01 of the Rochester Code of Ordinances is
hereby created and enacted to read as follows:
Subd. 9. "On-Leash Area" means any of the following areas:
A. Any portion of a City park, except for a City dog park, located
within:
(1) Twenty-five feet of locations where special events,
concerts, or organized sporting event are being held,
except for organized events where dogs are the
participants;
(2) Twenty-five feet of playgrounds, built structures, paved
areas, picnic shelters, or sports fields during such time
when others are present at any of these facilities; or
(3) A 25-foot trail corridor centered on any maintained trail;
B. Any portion of Quarry Hill Park, except for the unimproved field
located south of the baseball diamonds in the southwest
corner of the Park;
C. Any public sidewalk; or
D. Any public place posted with a sign that reads "On-Leash
Area."
Section 3. Section 4513.10 of the Rochester Code of Ordinances is hereby amended
and reenacted to read as follows:
4513.10. Animals. Subdivision 1. No person shall take, ride, drive, or
conduct into a park or upon any parkway, any quadruped or other animal except
the following:
A. Dogs that are under control of a responsible person in
compliance with the requirements of subdivisions 2 and 3 of
this section;
B. Horses that are being used for carriage rides pursuant to a
permit issued by the park board under the provisions of this
code; and,
C. Such other animals as shall be permitted under the direction of
the superintendent of parks.
Subd. 2. Dogs while in City parks, except for City dog parks, shall be
kept on a leash not longer than ten feet when they are:
A. Within 25 feet of locations where special events, concerts, or
organized sporting events are being held, except for organized
events where dogs are the participants;
B. Within 25 feet of playgrounds, built structures, paved areas,
picnic shelters, or sports fields during such time when others
are present at any of these facilities;
C. Within a 25-foot trail corridor centered on any maintained trail;
D. Within any portion of Quarry Hill Park except for the
unimproved field located south of the baseball diamonds in the
southwest corner of the Park; or
E. Upon any public sidewalk.
Subd. 3. At all other locations within the parks, dogs must at all times
be under the control of a responsible person by command, leash, chain, cable or
kennel. Dogs under control of a responsible person by command must remain
within sight of the person and be adequately trained to return to the person when
called. The responsible person must control the dog by command or leash when
others approach.
Subd. 4. Dogs that have been designated as dangerous or potentially
dangerous pursuant to section 106A.18 or state law may not be in a park unless
they are muzzled and restrained by a substantial chain or leash, and under the
physical restraint of a responsible person.
Section 4. Subdivision 4 of Section 106A.01 of the Rochester Code of Ordinances is
hereby amended and reenacted to read as follows:
Subd. 4. "At large" means, for an On-Leash Area, not under the control of
the owner or some other person of suitable age and discretion by leash, chain, or
cable, none of which may be longer than ten feet in length, or fence, kennel, or
other suitable enclosure. "At large" means, for an Off-Leash Area, not under the
control of the owner or some other person of suitable age and discretion by
command or by leash, chain, cable, fence, kennel, or other suitable enclosure. An
animal enclosed within a residence, dwelling, business, or other structure so that it
cannot leave on its own volition shall not be considered "at large."
Section 5. Subdivision 6 of Section 106A.01 of the Rochester Code of Ordinances
is hereby amended and reenacted to read as follows:
Subd. 6. "By Command" means the dog must be under the control of the
responsible person by command, must remain within sight of the responsible
person, and must be adequately trained to return to the responsible person when
called.
Section 6. Subdivision 3 of Section 106A.18 of the Rochester Code of Ordinances
is hereby amended and reenacted to read as follows-
Subd. 3.
ollows:Subd. 3. No person shall take a dog that has been declared dangerous or
potentially dangerous into the City's dog parks or trails unless the dog is muzzled and
restrained by a substantial chain or leash, and is under the physical restraint of a
responsible person.
Section 7. This Ordinance shall become effective upon the date of its publication.
