RESOLUTION
WHEREAS, J.M. (Mac) Hamilton applied for an Arboretum Special District Final Plan
#R2016-008SD to permit the construction of a one-story 10,000 square building. The property is
located east of West Circle Drive N.W., south of Members Parkway N.W., and west of Nottingham
Drive N.W.; and,
WHEREAS, the proposed development is subject to the provisions of Ordinance #2247,
which establishes the Arboretum Special District and provides for procedures for approval of
projects within the Special District. In this instance, the applicant has applied for a final site
plan, which requires a Type III, Phase II review procedure. This requires public hearings at
both the Planning Commission and the City Council. According to the R.C.O. §60.327, this
application will need to be measured against the criteria applicable for conditional use permits
(Section 61.146) and also for a Restricted Development Preliminary Plan (Section 62.708);
and,
WHEREAS, the proposal is for a 10,155 square foot office building and associated
parking on a site that is approximately one acre in size. The site is located within the
boundary of an approved Project Development Plan from 2016 (see attached plan) that
included 221,760 square feet of restaurant, retail, and office uses. That project development
plan approval identified the subject site for a one-story office building. Final site plans have
been approved for two buildings within the Project Development Plan boundary for the Think
Bank Headquarters (2001) and the Think Bank site (2005); and,
WHEREAS, with respect to R.C.O. §61.146 and assuming this application were
approved subject to conditions or modifications, the Planning Department staff suggests that
findings within this Section could not be made to support denial of this request; and,
WHEREAS, R.C.O. § 62.708 (Criteria for Type III Developments) provides the relevant
criteria for the review of this application; and,
WHEREAS, the Planning Department applied the criteria found at Section 62.708 to this
application and prepared the following findings of fact:
2) Final Development Plan Criteria:
a) Public Facility Design: Existing public facilities are adequate to
serve the proposed development. Infrastructure related
improvements or fees needed for approval have been added as
conditions of approval.

b) Geologic Hazards: There are no known geologic hazards on this
site. A wetland delineation has been carried out for the property and
is on file with the Planning Department. This portion of the site did not
have wetlands.
c) Access Effect: Access to the site will utilize existing driveway
entrances along Members Parkway to the north and Nottingham
Drive to the east. Parking spaces are oriented to limit headlight
glare to surrounding residential dwellings.
d) Pedestrian Circulation: The site will connect a walkway along the
building frontage to the existing sidewalk network along Members
Parkway NW and Nottingham Drive NW. Future adjacent
development is also intended to connect to the existing pedestrian
network.
e) Foundation and Site Plantings: The submitted landscaping plan
identifies boulevard trees, building foundation plantings, and shade
trees to screen a proposed trash storage area. The number of
boulevard trees does not meet the requirements of the Zoning
Ordinance. Prior to the approval of building permits, a revised
landscaping plan that meets the applicable requirements shall be
submitted to the Planning Department. Other site landscaping
complies with applicable requirements of the Zoning Ordinance,
and will be consistent with the landscaping of surrounding
commercial development.
f) Site Status: The site is within an existing block that is intended to
be subdivided into three lots in the future. The site is being
developed with the intent of existing as one lot. Provisions for
stormwater, parking, and landscaping are intended to be provided
within the future lot at the time of subdivision.
g) Screening and Bufferyards: The development is not required
to provide bufferyards other than required boulevard trees. A
landscaping plan was submitted identifying boulevard trees. The
number of boulevard trees does not meet the requirements of the
Zoning Ordinance. Prior to the approval of building permits, a
revised landscaping plan that meets the applicable requirements
shall be submitted to the Planning Department.
h) Final Building Design: The proposed building and site design

comply with applicable requirements of the Zoning Ordinance and
are consistent with the layout proposed within the approved Project
Development Plan.
i) Internal Circulation Areas: The design of the parking area is
consistent with the approved project development plan and
complies with requirements of the Zoning Ordinance. The amount
of parking proposed with this development exceeds the
requirements of the ordinance.
j) Ordinance Requirements: The submitted application materials
illustrate compliance with requirements of the B-4 zoning district for
signage and other appearance controls. Access to the site will be
provided through existing streets and driveways, which comply with
traffic visibility and emergency access standards.
k) Non-Vehicular and Alternate Travel Modes: Pedestrian access
is provided to the front entrance of the building from the public
sidewalk along Members Parkway. A public sidewalk network
exists within the surrounding area to connect surrounding
developments. The proposed development includes an outdoor
patio on the north side of the building that serves as a pedestrian-
oriented space; and,
WHEREAS, on January 11, 2017, the Rochester Planning and Zoning Commission held a
public hearing on this restricted development preliminary plan, reviewed the application according
to the requirements of Section 62.708, adopted the Planning Department’s recommended findings
of fact and recommended approval of the application subject to the following conditions:
1. Prior to approval of building permits, access easements necessary for
vehicular access to the site from Members Parkway and/or Nottingham Drive
shall be recorded.
2. Prior to approval of building permits, a lighting plan showing proposed
lighting locations and details and a photometric plan consistent with
Exterior Lighting Standard C shall be submitted to the Planning
Department and approved.
3. The freestanding sign shown near the northwest corner of the site shall
have a maximum height of 8 feet and a maximum size of 50 square feet.
4. Prior to approval of building permits, a revised landscaping plan shall be

submitted showing:
A. Compliance with boulevard tree requirements of section 64.160 of
the Zoning Ordinance;
B. The intended shade tree species intended to screen the trash
enclosure area; and,
C. A 10 foot clear zone in front of the transformer pad. Plantings must
be kept at least 2 feet from sides and back of the transformer pad.
5. Prior to approval of building permits, Grading & Drainage Plan approval is
required for this application, as well as, payment of any applicable Storm
Water Management Plan Area Charge (SWMPAC), concurrent with said
plan approval. In addition, the execution of a City prepared Maintenance
Agreement will be required for any on-site storm water facilities.
6. Execution of a City-Owner Contract, and dedication of all applicable
easements will be required for any public infrastructure that is to be
constructed as part of this project.
7. Prior to approval of building permits, an address form and applicable fee
must be submitted to the Planning Department; and,
WHEREAS, the Common Council held a public hearing on the Arboretum Special District
Final Plan request on February 6, 2017, and permitted all interested persons to be heard; and,
WHEREAS, based upon a preponderance and substantial weight of the evidence

submitted at the February 6 public hearing, the Common Council accepts the Planning and
Zoning Commission’s recommended findings of facts and determines that the Applicant will satisfy
the criteria of section 62.708 if the above seven conditions are satisfied.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the Arboretum Special District Final Plan #R2016-008SD application to permit the
construction of a one-story 10,000 square building east of West Circle Drive N.W., south of
Members Parkway N.W., and west of Nottingham Drive N.W., is in all things approved subject to
the above seven conditions.
