HomeMy WebLinkAboutResolution No. 124-17 - WetlandReplacementPlan.ScenicOaksWest RESOLUTION WHEREAS, Hanson and Younge, LLC, proposed the filing of 2,245 square feet of Type 2 th wetland located on private property south of 48 Street S.W., west of the Scenic Oaks Subdivision within the proposed Scenic Oaks West Subdivision. The wetlands consist of Type 2 wet meadow wetlands located adjacent to an ephemeral stream. Wetlands are proposed to be filled due to the th proposal to construct a crossing for a required street connecting the proposed development to 48 Street S.W. The applicant will avoid impacts on the remaining 0.47 acre wetland; and, WHEREAS, the Technical Evaluation Panel (“TEP”) reviewed the alternatives and found that they meet the minimum standards for sequencing. The Technical Evaluation Panel agrees that avoidance of the wetlands is not feasible due to the configuration and location of the wetlands on the property, topography, and required right-of-way alignment. The minimum replacement acreage is 4,490 square feet. The applicant proposes replacement in a BWSR-approved wetland bank located north of Chatfield within Olmsted County; and, WHEREAS, the wetland replacement is at a 2:1 ratio because the replacement wetland is in-kind replacement. The TEP did not object to the wetland replacement plan; and, WHEREAS, the TEP reviewed the application and recommended approval subject to the below described conditions: 1. The applicant must provide a copy of the Wetland Bank Transaction Form to the Planning Department once the purchase of credits is approved by BWSR; 2. The applicant must obtain a grading plan approval from the city; 3. The applicant must submit as built surveys to assure compliance with the proposed grading plan; and, WHEREAS, this matter came before the City of Rochester Common Council on March 20, 2017, for a final decision on the replacement plan. The Council considered all information presented to it including that information found within the Council Agenda packet. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Delineation and Replacement Plan presented by Hanson and Younge, LLC, for the filing of 2,245 square feet of Type 2 wetland located on private property th south of 48 Street S.W., west of the Scenic Oaks Subdivision within the proposed Scenic Oaks West Subdivision subject to the above three conditions. The Mayor and the City Clerk are authorized and directed to approve this plan on behalf of the City.
