HomeMy WebLinkAboutOrdinance No. 4294 - Second Reading: RCO Amendment to Chapt. 76 & 5 ORDINANCE NO. _____ AN ORDINANCE AMENDING AND REENACTING SECTION 76.03, AND SUBDIVISION 2 OF SECTION 5.03, AND REPEALING SECTION 76.05, OF THE ROCHESTER CODE OF ORDINANCES RELATING TO UNLAWFUL ACTS AFFECTING SEWERS AND THE ABILITY TO ISSUE ADMINISTRATIVE CITATIONS. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Chapter 76.03 of the Rochester Code of Ordinances is hereby amended and reenacted to read as follows: 76.03. Unlawful Acts. Subdivision 1. It shall be unlawful for any person to place, deposit, or permit to be deposited in any unsanitary manner on public or private property within the City, or in any area under the jurisdiction of said City, any human or animal excrement, garbage, or objectionable waste. Subd. 2. It shall be unlawful to discharge to any water- course within the City, or in any area under the jurisdiction of said City, any wastewater or other polluted waters, except where suitable treatment has been provided in accordance with subsequent provisions of this ordinance. Subd. 3. Except as hereinafter provided, it shall be unlawful to construct or maintain any privy, privy vault, septic tank, cesspool, or other facility intended or used for the disposal of wastewater. Subd. 4. No person shall uncover, make any connections with or opening into, use, alter, or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the City Engineer. Subd. 5. Violations of this section are a misdemeanor. In addition, designated City staff may issue an administrative citation pursuant to chapter 5 of this Code. Section 2. Section 2.
