HomeMy WebLinkAboutResolution No. 261-17 - FirstAvenueFlats.AmendRestrictedDevelopFinalPlanR2014-022CUP.Weis RESOLUTION WHEREAS, on April 20, 2015, the City of Rochester Common Council adopted Resolution #185-15 which approved Restricted Development Final Plan #R2014-022CUP by Joe Weiss for First Avenue Flat, subject to one condition of approval; and, WHEREAS, condition of approval #1 found within Resolution #185-15 stated as follows: 1. The Council’s actions in approving this development occur in response to the applicant’s or his/her representative’s oral and written representations as to the appearance of the building design, exterior façade, and landscaping. As such, the applicant must not deviate from the appearance of the building design, exterior façade and landscaping as originally presented to the Council without the Council’s prior approval; and, WHEREAS, pursuant to condition #1, the developer has requested Council approval of the following changes to the development: Proposed site design changes: 1. Relocation of electrical equipment from the 1st Avenue NW frontage to the southeast corner of the site. This relocation resulted in the placement of the equipment in a less-visible location at the back of the site, and will allow for the consolidation of electrical equipment with future development to the east using the same junction box (see RPU diagram in the attachments); 2. Revision of the surface parking layout to accommodate relocated electrical equipment, which reduces the overall total by one space to 85 parking spaces. According to the original staff report for the preliminary restricted development, this residential use would require 94 parking spaces under the R-4 zoning district. The site was approved for 86 parking spaces; 3. Removal of landscaping in the southeast corner of the site in the electrical equipment location; 4. Changes to walkway and landscaping layout of yard area along the First Avenue frontage, including: (a) the addition of block retaining wall along the First Avenue frontage at the southwest corner of the site; and (b) the relocation of tot lot to the south of the approved location; and, 5. Removal of landscaping from the southeast corner of the site to accommodate relocated electrical equipment. Proposed exterior building design changes: 1. Adjustments to building materials on all facades; 2. Addition of windows on south façade; and, 3. Adjustments to window pattern on north and east facades; and, WHEREAS, the Council considered this request at its June 5, 2017, meeting; and, WHEREAS, the Planning Department made no recommendations for any additional conditions of approval should the Council approve the requested changes to the development; and th WHEREAS, at the June 5 council meeting, the Council concluded that the developer’s request should be approved. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City does hereby approve the above-described changes to the development known as Restricted Development Final Plan #R2014-022CUP by Joe Weiss for the First Avenue Flats. Resolution #185-15 is hereby amended to include the changes noted herein. The Mayor and City Clerk are authorized to execute any and all documents necessary to implement this resolution.
