HomeMy WebLinkAboutOrdinance No. 4309 - Second Reading: EstablishmentOlmstedMedicalCenterSpecialDistrict ORDINANCE NO. 4309 AN ORDINANCE CREATING AND ENACTING CHAPTER 64AA, AND AMENDING AND REENACTING SECTION 60.327 OF THE ROCHESTER CODE OF ORDINANCES, RELATING TO THE ESTABLISHMENT OF THE OLMSTED MEDICAL CENTER SPECIAL DISTRICT. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Chapter 64AA of the Rochester Code of Ordinances is hereby created and enacted to read as follows: 64AA. OLMSTED MEDICAL CENTER SPECIAL DISTRICT 64AA.100. It is the intent of this Special District to assist the growth of the neighborhood Medical Facility by creating special zoning approaches that will permit additional development of the existing medical facility while maintaining the integrity of surrounding residential development. These zoning approaches are applicable to institutions which have ownership of land large enough to be capable of accommodating multiple buildings that are able to use shared parking, loading, and material handling. This framework is important for the continued growth and vitality of the neighborhood and City. Olmsted Medical Center is a not-for-profit organization engaged in services benefitting the public’s health, safety, and welfare. 64AA.150 BOUNDARIES OF THE LAND. This ordinance shall apply to the following described property located within the City of Rochester, County of Olmsted, State of Minnesota: Lot 18, AUDITOR'S PLAT - A, Rochester, Minnesota, as more particularly described as follows: Commencing at the northeast corner of the Northeast Quarter of Section 1, Township 106 North, Range 14 West; thence South 01 degree 17 minutes 15 seconds East, assumed bearing, along the east line of said Northeast Quarter, 38.92 feet to a point of intersection with a line which is 33.00 feet southeasterly of, as measured perpendicular to and parallel with, the centerline of 4th Street SE for the point of beginning (said point also being the northeast corner of said Lot 18); thence continue South 01 degree 17 minutes 15 seconds East, along said east line, 1236.68 feet to the northeast corner of HOMESTEAD ADDITION, according to the recorded plat thereof (the next 3 courses are along the north and east lines of said HOMESTEAD ADDITION); thence South 89 degrees 37 1 minutes 13 seconds West, 287.52 feet; thence North 01 degree 21 minutes 26 seconds West, 442.40 feet; thence South 88 degrees 58 minutes 24 seconds West, 967.64 feet to a point of intersection with a line which is 33.00 feet southeasterly of, as measured perpendicular to and parallel with, the centerline of 4th Street SE; thence North 56 degrees 41 minutes 23 seconds East, along said parallel line,1481.01 feet to the point of beginning. EXCEPT: That part of Lot 18, AUDITOR'S PLAT - A, Rochester, Minnesota, described as follows: Commencing at the northeast corner of the Northeast Quarter of Section 1, Township 106 North, Range 14 West; thence South 01 degree 17 minutes 15 seconds East, assumed bearing, along the east line of said Northeast Quarter, 38.92 feet to a point of intersection with a line which is 33.00 feet southeasterly of, as measured perpendicular to and parallel with, the centerline of 4th Street SE (said point also being the northeast corner of said Lot 18); thence South 56 degrees 41 minutes 23 seconds West, along said parallel line, 38.92 feet for the point of beginning; thence South 01 degree 17 minutes 15 seconds East, 59.07 feet; thence North 89 degrees 20 minutes 41 seconds West, 47.04 feet; thence South 62 degrees 57 minutes 20 seconds West, 165.00 feet; thence South 01 degree 17 minutes 15 seconds East, 5.00 feet; thence South 56 degrees 41 minutes 23 seconds West, 165.00 feet; thence North 01 degree 17 minutes 15 seconds West, 32.27 feet to a point of intersection with a line which is 33.00 feet southeasterly of, as measured perpendicular to and parallel with, the centerline of 4th Street SE; thence North 56 degrees 41 minutes 23 seconds East, along said parallel line, 395.74 feet to the point of beginning. 64AA.200. EFFECTS OF REGULATIONS. Subd. 1. Applicability. The Special District established by this ordinance shall be an overlay zoning district with unique development standards on the property defined as the Olmsted Medical Center Special District, which is the property within the district boundary. Unless otherwise specified within these regulations, all other standards and requirements of the Rochester Zoning Ordinance remain in effect as though the property is zoned MRD #1 (Education and Public Service Campus) district. Subd. 2. Zoning Map. The boundary of the Olmsted Medical Center Special District shall be identified on the official Zoning Map as “SC-##.” 64AA.300. SPECIAL DISTRICT DEVELOPMENT STANDARDS 2 Subdivision 1. Permitted Land Uses. A. Permitted uses within the special district shall be limited to “Medical Facility.” Subd. 2. Sign Regulations. Signage on the site shall follow the Type C standards of the Zoning Ordinance except: A. Message center signs are not permitted; B. Free-standing business signage shall be limited to a maximum cumulative size of 200 square feet and a location no further south th of College Parkway along 19 Avenue; and, C. Free-standing auxiliary signs, if internally-illuminated, shall have an opaque background and may illuminate only letters, logos, and necessary directional characters of the auxiliary sign. A maximum of 200 square feet of free-standing auxiliary signage is permitted. Subd. 3. Bufferyard Requirements. A. Bufferyards shall follow the requirements of the MRD #1 district, except that a 4-foot-tall picket fence is not required. Subd. 4. Floor Area Ratio (FAR). A. Bulk standards of the MRD #1 district shall be required, except that development shall have a maximum FAR of 0.50 for development with a Type I review. Subd. 5. Permitted Maximum Height. A. Within 100 feet of a developed R-1 district where the use is residential, the height shall be limited to 35 feet. Elsewhere, the limit is 75 feet. Section 2. Section 60.327 of the Rochester Code of Ordinance is amended and reenacted to read as follows: 60.327 SD SPECIAL DISTRICTS: Existing Special Districts approved by Ordinance numbers 3443, 3404, 2726, 2516, 2247, 3385, 3468, 3497, 3503, 3520, 3534, 3604, 3615, 3691, 3730, 3814, 3889, 3919, 4003, 4122, 4194, 4199, 4236, and 4309 are recognized as separate zoning districts and the plans and procedures established for each Special 3 District will continue in force. When a Special District Ordinance does not specify the procedure or criteria to amend an approved site development plan, the proposed amendment will be reviewed under section 61.148. When a Special District Ordinance requires a specific site/development plan review process, but does not specify the criteria by which to review the site/development plan, the development will be reviewed under section 61.148. When a Special District Ordinance requires a two-phase review, the development will be reviewed under section 61.146 and either section 62.708 (1) (for preliminary plans) or section 62.708 (2) (for final plans). Section 3. This Ordinance shall become effective on and after the date of its publication.
