RESOLUTION WHEREAS, on June 15, 2017, the Common Council of the City of Rochester adopted Resolution No. 300-15 vacating a utility easement recorded as document number 571243 and th located over a portion of the property located at 3089 25 Street N.W.; and, WHEREAS, Resolution No. 300-15 contained a legal description of the area to be vacated; and, WHEREAS, the legal description found within Resolution No. 300-15 is in error and needs to be replaced with an accurate legal description; and, WHEREAS, the Council wishes to amend Resolution No. 300-15 so as to delete the legal description found within the Resolution and to insert in lieu thereof the following accurate legal description: That part of watermain easement recorded in Book S-3, Page 540 which lies within the property described as: The Northerly 208.71 feet of the Westerly 258.71 feet of the Northeast Quarter of Section 28, Township 107 North, Range 14 West, Olmsted County, Minnesota. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that Resolution No. 300-15 be amended so as to delete the legal description found within the Resolution and to insert in lieu thereof the following legal description: That part of watermain easement recorded in Book S-3, Page 540 which lies within the property described as: The Northerly 208.71 feet of the Westerly 258.71 feet of the Northeast Quarter of Section 28, Township 107 North, Range 14 West, Olmsted County, Minnesota. BE IT FURTHER RESOLVED that the remainder of Resolution No. 300-15 be reaffirmed and remain in effect.
