HomeMy WebLinkAboutResolution No. 371-17 - IncentDevFinalPlan.R2015-015CUP.501on1st,LLC RESOLUTION WHEREAS, on June 15, 2015, the City of Rochester Common Council adopted Resolution st #305-15 which approved Incentive Development Final Plan #R2015-015CUP by 501 on 1, LLC subject to 13 conditions of approval; and, WHEREAS, condition of approval #13 found within Resolution #039-15 stated as follows: 1. The Council’s actions in approving this development occur in response to the applicant’s or his/her representative’s oral and written representations as to the appearance of the building design, exterior façade, and landscaping. As such, the applicant must not deviate from the appearance of the building design, exterior façade and landscaping as originally presented to the Council without the Council’s prior approval; and, WHEREAS, on March 21, 2017, pursuant to condition #13, the Council adopted Resolution #124-16 which amended Resolution #305-15 by approving two changes to the development and adding three additional conditions of approval (conditions #14, #15, and #16); and, WHEREAS, pursuant to condition #13 of Resolution #305-15 as amended by Resolution #124-16, the developer has requested Council approval of the following changes to the development: 1. Constructed building elements that have changed from the approved drawings: A. Omission of railing along sidewalk through alley; B. Additional windows on the south side façade of the building; C. Addition of white vents on west building façade; D. Additional awnings proposed above storefront windows; E. Change of light fixtures from sconce lights to recessed can lights; F. Addition of louvres on the east façade of the south wing; and G. Addition of dryer exhaust vents on the façade. 2. Constructed site design elements that have changed from the approved drawings: A. Redesign of northeast patio space; B. Omission of raised curbs around planter areas in the right-of-way; and, C. Reduction of landscaping materials around mechanical equipment on the south side of the building; and, WHEREAS, the developer also requested the deletion of condition of approval #13 from Resolution #305-15; and, WHEREAS, the Council considered this request at its August 21, 2017, meeting; and, WHEREAS, the Planning Department made no recommendations for any additional conditions of approval should the Council approve the requested changes to the development; and st WHEREAS, at the August 21 council meeting, the Council concluded that the developer’s request should be approved as to items #1(B) through #1(G) and item #2 as described above, but denied as to item #1(A) and the request for the deletion of condition of approval #13. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City does hereby approve the above-described changes to the development known as st Incentive Development Final Plan #R2015-015CUP by 501 on 1, LLC as to items #1(B) through #1(G) and item #2. BE IT FURTHER RESOLVED that the Council denies the changes requested in items #1(A) and the request for the deletion of condition of approval #13. BE IT FURTHER RESOLVED THAT Resolution #039-15 as amended by Resolution #124- 16 is hereby further amended to include the approved changes noted herein. The Mayor and City Clerk are authorized to execute any and all documents necessary to implement this resolution.
