RESOLUTION
WHEREAS, pursuant to t he City of Rochester’s Capital Improvement Plan, a report has
been prepared by the City Engineer with reference to proposed Improvement J7317, Reconstruction
of 9 Avenue SW, to rehabilitate 9th Avenue SW from 6th Street to 7th Street, and this report was
received by the Council on December 4, 2017; and,
WHEREAS, the report provides information regarding whether the proposed
improvement is necessary, cost-effective, and feasible; whether it should best be made as
proposed or in connection with some other improvement; the estimated cost of the
improvement as recommended; and a description of the methodology used to calculate
individual assessments for affected parcels.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the City does hereby approve the following actions:
1 Amend and accept the feasibility report to reflect the changes noted within this
Resolution;
2. Consider the improvement of such street in accordance with the amended feasibility
report and the assessment of abutting property for all or a portion of the cost of the
improvement pursuant to Minnesota Statutes, chapter 429 at an estimated total cost
of the improvement of $629,706. Assessments to be apportioned by front footage
abutting lots for those costs over $150,000 (City share);
3. Choose Alternate A to reconstruct the street using existing brick as much as
possible;
4. Order the public project hearing for this proposed improvement to be held on
January 17, 2018, in the Council Chambers of the Rochester City Hall at 7:00 p.m.,
and order the City Clerk to give mailed and published notice of such hearing and
improvement as required by law; and,
5. Waive the requirement for sidewalks at this time, but require all of the property
owners to enter into an assessment agreement with the City prior to the January 17,
2018, assessment hearing. The assessment agreement will, among other things,
defer the property owner’s obligations to pay for the construction of sidewalks on
their street until such time as the City Council adopts a plan to address walkability
and the location of sidewalks within the entire Historic Southwest District; and,
The Mayor and City Clerk are authorized to execute any and all documents necessary to
implement this resolution.
